BSKB professionals, Dr. Hailey Bureau and Gerald “Jerry” Murphy, recently published an article with Law360. Their article “How High Court Amgen Case Could Alter Patent Enablement” discusses the effect that the Amgen v. Sanofi decision has had at the district court level and at proceedings at the USPTO. In particular, they describe how the pending decision by the U.S. Supreme Court will further affect the future of patent applications and patents regarding claim validity and enablement.

As 2022 has come and (almost) gone, it’s time to look back at the exciting grants and surprising denials of certiorari petitions involving patent and trademark matters by the Supreme Court of the United States, and what to look forward to from the Court in 2023.

After a year of hard work, we had so much fun celebrating with our coworkers at the annual BSKB Holiday Party! This was the first time some of us were able to meet each other in person in over two years! We enjoyed good food, drinks and conversation as we celebrated the holiday season.

BSKB's Dr. Hailey Bureau was recently published in World Intellectual Property Review 's latest digital edition of World IP Review. In her article, “A new prescription for negative claim limitations,” Dr. Bureau discusses the CAFC’s precedential reversal in Novartis Pharms Corp v Accord Healthcare (Fed Cir, June 21, 2022) in regards to negative claim limitations. Dr. Bureau writes, “Not only does this decision raise the standard for written description support for negative limitations, but it also raises a unique procedural issue.” Check out the rest of the article here!

BSKB’s Trademark Partner Mike Smith was recently quoted in an article by Bloomberg Law regarding Kim Kardashian’s new skin care line “SKKN by Kim”. The article discusses the launch of Kardashian’s brand despite the uncertainty surrounding the trademark and other brands that sell similar products under similar names. Mr. Smith’s quote reads “In this case, I think the marks are very similar. The goods seem to be the same or closely related. When those two factors weigh in favor of infringement, then typically you have a pretty good case.”

Who Owns ‘Skin’? Kardashian’s ‘SKKN’ Facing Trademark Ambiguity Kim Kardashian’s long-anticipated skin care line is set to launch Tuesday despite a mist of legal uncertainty surrounding her proposed “SKKN by Kim” trademark.

BSKB's Hailey R. Bureau, Ph.D., was quoted in an article for Bloomberg Law regarding recent rulings by the US Court of Appeals for the Federal Circuit regarding strict enforcement of certain Patent Act provisions. These rulings regarding Section 112, a written description requirement and an enablement standard, have created a high burden for Applicants in the life science industry to overcome.
Dr. Bureau was quoted saying "Hopefully the Supreme Court can provide a course correction for the course we’re on now. The court has been on this path for the past decade, but now it seems like the past three very recent decisions came to a head in the past year.”
Pharma Patents Threatened by Federal Circuit, Petitions Say (1) Pharmaceutical patent owners’ growing frustration with the Federal Circuit’s tightening of Patent Act provisions that require inventors to fully describe what they’ve created has led to multiple Supreme Court petitions seeking to bring the country’s primary patent appeals court to heel.
