[08/25/21]   Virginia parents have four options to sign a proposed IEP:
1. Consent to implementation in its entirety.
2. Not consent to the implementation,
3. Partially consent to the IEP, or
4. Not sign the IEP.
The online IEP signature portal used by several school districts improperly does NOT give parents the option to sign in partial consent. Belkowitz Law, PLLC can help.

The Interim Report for Year 1 of the Special Education Audit is posted to BoardDocs (see the link in the comments below).

Originally there was to be a work session discussing the interim report today, July 13th, but that work session has been moved to the Fall to ensure that the school board has time to publicly discuss the plan for the ESSER 3 funds. We will share the rescheduled work session date as soon as we are aware of it.

Did the school unilaterally cancel or change your child's summer ESY? The IDEA requires that the school implement the student's IEP. A school cannot unilaterally change your child's IEP services (including summer ESY) without a parent's consent.

[11/19/20]   Is your child unable to wear a facemask due to a disability? Virginia’s face mask requirement does not apply to “persons with health conditions or disabilities that prohibit wearing a face covering,” although you should consider “adaptations and alternatives . . whenever possible” to protect against transmission of COVID-19. Moreover, a business or government cannot require a person with a disability (or a health condition) to “produce or carry medical documentation” or identify “the precise underlying medical condition.”
@BelkowitzLaw can help if your child’s rights are denied.

This useful information is not applicable just to health care professionals. It applies to education and all other aspects of daily life. #belkowitzlaw #SPED #presumecompetence

VCU Partnership for People with Disabilities just completed a poster for healthcare professionals on how to communicate with people with disabilities. Read more below!

"All Patients Deserve RESPECT

Fostering an environment for open communication during health care appointments may be difficult for patients with intellectual and developmental disabilities (IDD) because of differing communication styles and possibly a patient's limited understanding of the healthcare setting and their own healthcare needs. This resource provides a few tips you can employ to create a partnership with your patients with IDD and empower them to become more involved in their own healthcare. To remember the tips, just think all patients deserve RESPECT.

1. Relax and interact with patients with a disability no differently than patients without disabilities.
-You may feel uncomfortable around patients with a disabilities and that is okay.
-Time and practice can help you overcome these feelings.

2. Explain what you will be doing before completing an action or procedure.
-Consider using visual aids to help explain procedures.
-Ask before touching.
-Enlist the help of others who know the patient well when necessary.
-Allow a patient to ask you questions. Consider asking: 'Do you have any questions about what we will be doing today?'

3. Speak directly to a patient before speaking with a family member or direct support staff.
-Ask open ended questions to solicit in-depth responses.
-Be an attentive listener and use language that is respectful, age appropriate, and spoken in a normal tone of voice.
-Rephrase and simplify medical terminology.
-Value and respect patient'd preferred communication methods; such as writing things down, talking mats, finger spelling, facial expressions, vocalizations, gestures, sign language, etc.

4. Plan to have conversations about a patient's preferences for appointments and follow-up care.
-Consider asking: Who should I speak to during appointment? Do you have any preferences for your visit today? Is there anything you want me to do differently next time? Do you need help with any tasks? Do you need me to write down the date and time of your next appointment or instructions for what to do when you leave today?

5. Engage patients in healthcare related conversations, decisions, and plans.
-Offer choices for treatments, medications, and follow-up care.
-Consider asking: Is there anything health related you would like to talk about today? Do you have any questions for me?

6. Confirm if legal guardians need to be involved in treatment conversations.
-If a patient has a legal guardian, they may not legally be allow to make decisions about their healthcare no matter their age.
-Regardless of guardianship status, a patient's opinion should always be solicited and acknowledged.

7. Talk with patients about health priorities and steps necessary to reaching goals.
-Explain the concept of health priorities (i.e. health issues, concerns and goals)
-Facilitate conversations about how being healthy and daily actions are related to health priorities.
-Listen to and address all health concerns regardless of the person's disability.
-Provide patients with information they need to live a healthy life."
