Military Benefits Subtraction beginning as of January 1, 2022 expected to be signed by the Governor

Introduced by Delegate John, J. McGuire, III (R) - House District 56, HB 1128 & SB 528 as a compromise bill passed and swill likely be signed by the governor Glenn Youngkin. The Bills establish an income tax subtraction for up to $20,000 of military benefits in taxable year 2022, up to $30,000 in taxable year 2023, and up to $40,000 in taxable year 2024 and each year thereafter. The bill defines military benefits to include military retirement income and benefits paid to the surviving spouse of a veteran. The bill contains an emergency clause.

SDAT Raises Business Personal Property Exemption From $2,500 TO $20,000

BALTIMORE, MD – The Maryland State Department of Assessments and Taxation (SDAT) today announced that HB268, which raises the exemption from personal property assessment for all Maryland businesses from $2,500 to $20,000, has taken effect. This legislation will save 14,217 businesses from paying taxes on $44.2 million in assessment, and is an extension of HB90, which SDAT sponsored in 2018 and exempted 28,493 businesses from $10.8 million in assessment.

“Thanks to these legislative efforts, 42,000 of Maryland’s smallest businesses will not have to pay taxes on $55 million in assessment,” said SDAT Director Michael Higgs. “The department remains committed to playing a role in reducing taxes, supporting businesses and changing Maryland for the better.”

HB268 took effect on June 1, 2022, and is effective for tax years starting after June 30, 2022, and includes annual filings submitted as early as January 2022. SDAT will automatically adjust assessments of filings that were submitted between January 1, 2022, and June 30, 2022 so that reported business personal property less than $20,000 is not assessed.

Late filing penalties previously billed on 2022 business personal property returns reporting less than $20,000 have been abated and filers who have already paid a late filing penalty billed on a return filing reporting less than $20,000 are being mailed a refund check for the penalty paid.

Beginning in 2023, filers with a total original cost of personal property less than $20,000 will also be able to self-attest on their Annual Report that their personal property falls within the exemption range and will no longer be required to submit a return detailing their personal property.

To celebrate the addition of Naomi and John and to reflect the growth in the practice we are renaming the firm Aiken Warner Leonard PLLC. Our primary goal remains to continue to provide the same level of professional care to our valuable clients. Your continued trust in our firm is our greatest compliment and the reason that we can celebrate 36 years of success!

We are also pleased to announce that after more than 50 years in public accounting, our founding partner Tony Aiken has decided to fully retire and spend his time doing what he loves most – woodworking, reading, fly fishing, drinking fine wine, volunteering in the community, and spending time with his grandchildren. We hope to carry on Tony’s commitment of excellence to the profession, to the clients, and to the community, and are thankful for his wisdom and guidance that shaped our personal and professional lives.

We here at Aiken & Company want to alert you to a few recent IRS developments that may be of interest, as highlighted by The Kiplinger Tax Letter:

1. Deferring Capital Gains: You can defer capital gains on the sale of business or personal property by investing the proceeds in Qualified Opportunity Funds. This means that you could actually sell stocks, mutual funds, or a painting in your house for $1 million, invest the proceeds tax free and watch it grow.
2. Family-Owned Businesses Take Note: For estate and gift tax purposes the Biden administration will probably bring back the elimination of valuation discounts on intra-family transfers. If you are considering splitting up your company into smaller pieces for estate purposes, you may want to think about doing it in the next year or two.
3. Meals Are Back on the Table: Beginning in 2021 and ending after 2022, business meals (food and beverages) are 100% deductible. However the meals must be provided by a restaurant (delivery counts!)
4. Changes to Itemized Deductions: If you itemize, a few updates to be aware of – the threshold on medical expenses has been permanently set at 7.5% of adjusted gross income (rather than the 10% it was set to revert to). Mortgage insurance premiums are deductible through 2021. And even if you will be taking the standard deduction, $300 of charitable donations can be deducted in addition to the standard deduction; and for 2021 only, the deduction is $600 for married filing jointly returns.
5. Have You Moved? It’s worth filing Form 8822 Change of Address with the IRS; in case of any subsequent deficiency notices. They are required to mail them to your last known address.
