Folks, see my post about my Op-Ed today with Fairfax County Commonwealth's Attorney Steve Descano regarding Jason Miyares’s distractions from the real effort to protect victims and address violent crime. Full text of the op-ed in the post below.
On Monday, I joined my colleagues to raise awareness on Virginia's Emergency Substantial Risk Order (ESRO) law, commonly referred to as a “red flag law."

The ESRO enables the Fairfax County Police Department to investigate and seek a court order to temporarily remove a gun or guns from individuals who have been determined to be an imminent danger to themselves or others. ESROs prevent individuals who show signs of being a threat to themselves or others from purchasing, possessing, or transporting any kind of firearm while providing necessary procedural safeguards to ensure that no firearm is removed without due process. This creates safer circumstances for the individual to seek treatment, stabilize their behavior, or access resources to address the underlying causes of their dangerous behaviors.

As Chair of the Council to End Domestic Violence, my work is to support & facilitate the work of the professionals and volunteer advocates who are out in our community on the front lines each and every day. We know that guns and domestic violence do not mix. Sadly, 4.5 million women in America have been threatened with a firearm. A victim of domestic violence whose abuser has access to a firearm is 5 times more likely to be murdered. That’s why this mission is so important, and why we need to spread the word about the ESRO law which gives us another tool to prevent domestic violence.

I want to thank Public Safety Committee Chair Supervisor Rodney Lusk and Chairman Jeff McKay for initiating this public awareness campaign, Fairfax County Police Department and Fairfax County Commonwealth's Attorney Steve Descano for facilitating the ESRO process, Fairfax County Department of Family Services' Domestic and Sexual Violence Services and Fairfax-Falls Church Community Services Board for their work to prevent su***de and domestic violence, and Safer Country for advocating for this campaign.

Four years after the fatal shooting of Bijan Ghaisar, the U.S. Department of the Interior and National Park Service have recommended the removal of Officer Lucas Vinyard and Officer Alejandro Amaya.

The United States Park Police FOP sent a blistering letter to membership, accusing Deb Haaland and others in leadership of anti-police, anti-union bias:

“The people who demanded we stand on a police- line for weeks on end while getting pummeled by bricks and p**s balloons are the same people who despise us. The people that demand you show up to work on your days off for an anti-police march are the same people that will fire you for using justified force against them. They will smile in your face and fire you right before the holidays. They won’t lose any sleep while you struggle with what might happen to your family.”

Fairfax County Commonwealth's Attorney Steve Descano got a grand jury indictment against the officers for involuntary manslaughter and improper use of a firearm, the case was removed to federal court.

Last month, a federal judge dismissed the charges, saying the officers’ actions met the standard of necessary and proper, and therefore they have immunity from prosecution. Fox 5 DC

I filed a show cause in august for multiple violations of a court order that are still on going since July and still haven’t heard a word about a court date. Ive missed multiple weekends including my daughters 5th birthday and probably won’t see her for the holidays because her mother is mad that I got married. I reached out to law enforcement to enforce the criminal violations but they refused to replying “ they don’t touch civil cases”

I would love to see a new law go into effect that would freeze assets coming from non custodial parents when the custodial parent chooses to violate a court order. If I stopped paying my daughters mother I would be arrested and in jail in a heart beat yet she’s about to commit her 10th misdemeanor in a row without an inch of repercussion.

This set of scales within our justice system needs to be calibrated urgently there is nothing equal about it.
Folks, Jason Miyares spent the whole campaign pushing bogus, 90s-retread, "tough on crime" rhetoric that, even if he had the constitutional authority to put it into practice, would make us less safe, waste money, and feed mass incarceration.

Nevertheless, our AG Elect wasted no time keeping up that rhetoric, when at his very first post-election press conference he called for a new law to let him come in and overrule local prosecutors duly elected by the will of their communities.

As luck would have it, the Virginia Attorney General's job is to run Virginia's law firm. He is not, whatever the rhetoric may say, the "Top Cop" or the boss of Commonwealth's Attorneys. By law, Commonwealth's Attorneys answer to nobody but to their fellow citizens via the ballot box.

If you want to know how I feel about an AG getting between my office and the will of Norfolk's voters, read the Washington Post Op-Ed by my friend, Fairfax County Commonwealth's Attorney Steve Descano. He is spot on.

And if you are curious as to whether Jason has any chance of getting that law passed, the answer is no. Our Virginia Senate Democrats Judiciary Committee Chair John Edwards has gone on record that he will not stand for it.

As for me, I ran on the promise to keep my fellow Norfolk citizens safe by pursuing justice, equity, and accountability and by fighting against mass incarceration, the school-to-prison pipeline, and the criminalization of poverty, mental illness, substance-use disorder, and homelessness.

Anyone who wants to contravene the will of my fellow citizens and the good of the City of Norfolk will have to go through me.
