Realtors, please don’t tell buyers, “You’ll find out everything you need to know from the inspection.”
1) That’s not accurate.
2) It doesn’t mitigate failure to disclose issues, particularly those which cannot be discovered during inspection.
3) While I never advise realtors to assist in filling out disclosures, you DO have an affirmative duty to disclose any known material defects to the buyer, which seller didn’t disclose. That should be done in WRITING to protect yourself.
These matters are presented to my office almost daily, and both buyers and sellers are being harmed.

SELLERS: Real estate contracts should be taken with the same level of seriousness and commitment as any other contract. If you “change your mind” after signing on the dotted line, you will open yourself up to serious legal and financial consequences. In other words, don’t expect any represented party to simply walk away.

Contract disputes are among the most common cases we encounter. We’ve recently been able to “undo” thousands of dollars in potential damages, but the clients would’ve saved even more thousands (not to mention added stress and anxiety) if they had enlisted legal assistance on the front end.

Homebuyers: If I could give only one free tidbit of legal advice, it would be this—If you’re considering a home with an HOA, insist upon a copy of the CCRs prior to making an offer. Read them carefully. If the restrictions are too cumbersome, do not proceed. My office is bombarded with calls about overly intrusive and restrictive HOAs. Trust me: They can be your best friend or your worst enemy. Consequences of failure to comply range from penalties to foreclosure. Life is too short to deal with stressful and rigid demands. Sure, you might slow down or even forgo the purchase, but an ounce of prevention is worth a pound of cure.
