Texas State of Disaster Criminal Law Enhancements
On March 13, 2020, the Governor of Texas declared a state of disaster in response to the COVID-19 pandemic. For the purposes of criminal law in Texas, that disaster declaration activated the provisions of Texas Penal Code (TPC 12.50)
Criminal Law Consequences During a State of Disaster:
TPC 12.50 states that for the offenses listed below, if committed during the declaration of a state of disaster, the punishment level for these offenses is increased to the next higher category for that offense. For example, if a Theft charge would normally be punished as a Class B misdemeanor (0 – 180 days in jail and up to $2,000 fine) then it would be increased to a Class A misdemeanor (0 – 365 days in jail and up to $4,000 fine) if it is committed during the time of the declared disaster.
Specifically, TPC 12.50 applies to the following offenses:
* Assault and Family Violence
* Arson
* Robbery
* Burglary
* Burglary of Coin-operated or Coin Collection Machines
* Burglary of Vehicles
* Criminal Trespass
* Theft
TPC 12.50 is limited by the following provisions:
For the offenses of Assault, Burglary of Coin-operated/Coin Collection Machines, Burglary of Vehicles, Criminal Trespass or Theft, if the offense committed would normally be punished as a Class A misdemeanor, then during the emergency declaration the minimum term of confinement is increased from 0 to 180 days in a county jail.
For the offenses of Arson, Burglary, and Criminal Trespass, if the offense committed would normally be punished as a First Degree Felony, then there is no enhancement.

Law Enforcement will likely ask you questions, you have no obligation to provide them any information, other than your Identification. Give them your ID. If they ask questions, decline to answer. If they persist, ask for an Attorney. Please remain polite and respectful and obey any commands they give to move your body or to remain still. Your Constitutional Rights that protect you from self-incrimination are still active. Be smart, follow the law, and keep your distance. But don't waive your rights and subject yourself to prosecution when you can easily avoid it by remaining silent . If you forget, remember you can end the conversation at any time.

As always, we provide options for hand cleaning for clients and associates, and we work closely with our legal team to ensure that anyone who is not feeling well understands that we support them staying home.
What do I do if I have been exposed to the coronavirus while I need legal care?
In order to help us continue to serve our clients in need of legal care, we ask that clients who have recently traveled to a high-risk country, had any exposure to symptomatic or confirmed positive cases, or confirmed positive themselves, not come in to the law office, instead please call our office to speak to the Attorney at 361-888-4545. We offer both voice and video conferences.
If you, as a client, are due for any other non-urgent appointment, please call us to discuss rescheduling to a later time. If it is determined that your appointment cannot be rescheduled for any reason, and your appointment is necessary, we ask that you have only one healthy family member or friend accompany you to the appointment, if necessary.
