The Will Smith slap at the Academy Awards . . . an assault that occurred in public, I assume in view of at least one police officer. Why wasn't he arrested? Adequate provocation for the slap, under California laws? I doubt it.

If this was not staged, Smith about all the Prosecutor would have to do at trial would be to show the video.

Should Chris Rock sue him for assault? Arguably, he should, to prevent public assaults from taking place.

The issue regarding damages is complex. Will it hurt Chris Rock's career? Was he subject to public humiliation?

The lawsuit also would be easy to prove.

Ho about a products liability suit due to the design of the stage without an orchestra pit or an apron?

I was guessing the Defendant, Amber Prince, was filing a motion to reduce sentence, or motion for new trial. However, when I looked on line I found "Defendant's Motion for Pre-and/or Post-Sentence Investigation Report". So I guess there is an allegation by Amber Prince that the report was crucial for a fair sentence? They do these reports all the time in San Patricio County. In Nueces County you usually file a waiver of your right to a presentence investigation report when you plead guilty.

In San Patricio County the Probation office does a lengthy Pretrial Investigation Report which contains your education, substance abuse history, criminal record, marital status, etc. The Judge then uses that report to sentence you, using it in particular to decide if you have to go to a drug program.

One unfortunate result of Amber Prince's apparent effort to get out of 75 days in jail, may be that the same sentencing system will be used in Nueces County that is used in San Patricio County. One thing I do not like about it, in San Patricio is
there is not one day yo plead guilty and be sentenced. . In San Patricio County, like in Federal Court, you plead guilty one day and are sentenced another day maybe three months later.

And I am also guessing the Defendant does not want to serve her jail time of 12 days per year for the next five years.

The Defendant apparently pled guilty to receive five years probation, pursuant to a plea bargain, and did not think the Judge would give her jail time as a condition of probation. The Judge has the authority to give, I think up to 180 days in jail as a condition of probation for a felony; although the Judges in Nueces County seldom do this.

As Judge Klein was recused, guess we will see what the new Judge does. The new Judge could give her 180 days as a condition, as I recall. Or none.

One things for certain, a lot of money was spent in trying to get 75 days in jail eliminated. I think I counted about 20 total subpoenas, which I assume were by the Defendant, Amber Prince's, Attorney to obtain the recusal of the District Court Judge.

I wonder if this story that the police offered to arrest Will Smith is a sort of cover-up for the Los Angeles police department? The police see an assault occur live, and do not arrest the assailant, Will Smith. Of course, Chris Rock could have filed a non-prosecution affidavit later, and the prosecuting state agency could have considered dropping the case.

I know from my experience in defending Lou Diamond Phillips, that many films and series are filmed in Canada. And a conviction of even a misdemeanor could make it impossible for you to cross the border, to film there.

Well I have not researched this issue, but assuming it was real . . . . This was an assault that occurred in public, I assume in view of at least one police officer. Why wasn't he arrested? I would think, that Chris Rock does not have to file a complaint.

Was there adequate provocation for the slap, under California laws? I doubt it.

Will Smith, if this was not staged, is guilty of assault. About all the Prosecutor would have to do at trial would be to show the video.

Years ago I had a federal court appointment for man charged stealing helicopter engines from the a base. Everyone made a big deal out of the case. I argued, that it was no big deal, as they were going to scrap the engines anyway; and they were worth $50.00 in scrap metal.

I do not understand this story. Why would you want to remove a Judge, after she sentenced you? And it seemed like a very fair sentence for the Defendant. I did wonder about the legality of 15 days jail time, each year for five years during the course of probation. But I did not research it, because it is not my case. 😁

Jail and Prison Food

One time I was locked up in the San Patricio County Jail by a Justice of the Peace for contempt. I was there for lunch and had a chicken TV dinner.

Another time I was in a "Detention facility" visiting an inmate for about 5 hours, and I ate part of my clients meal, a breaded meat patty with gravy, on a slice of white bread. The patty was maybe just below frozen food quality, and the bread was the cheapest white bread you could buy.

In Texas, if you are in "solitary" or "isolation" you get to eat the "loaf." The loaf is all the leftovers from the previous day, which I understand to be vegetables, bread, desert, meat, etc., all baked into one appetizing loaf. It sounded pretty good to me, but at least one former prisoner referred to it as, "nasty."

One of the biggest new problems in criminal cases? These long periods of pretrial supervision.

People want modifications to the conditions; for example, their ankle monitor removed. Then later they want another modification, such as the ability to leave the county.

The problem is, as a fairly typical criminal lawyer that doesn't get court appointments, I do not charge enough ordinarily to draft a motion to modify; file it; and have it heard by the Judge at a hearing without charging an additional fee. Sometimes though, I will not charge a fee if the case is a larger one and I was paid a sizeable retainer. I try to be fair in this regard.

I am going to have to amend my contracts so this is specified, in writing.

I also desire to my "eye on the ball." That is, to defend the criminal case, and try not to get caught up in side issues, such as modifications to pretrial conditions.

And no, I do not believe it is fair, nor constitutional, that person's are punished by probation; before they are convicted of a crime. But I am not a member of the state legislature who passes such laws.

Federal Criminal cases locally, seem to be predominantly alien smuggling, wherein illegals are picked up in the United States near the border and transported to inland cities such as Houston. They used to be predominantly, marijuana cases; wherein. bales of marijuana were brought from Mexico to the U.S. in 18 wheelers. Often the marijuana was smuggled in produce such as cabbages.
