Conroe DWI Trial & the Importance of the SFSTs

The back to school photos on your feed signal the end of summer and a return to the grind. This summer we were still grinding - even went to a jury trial. Take a look at some of my post trial thoughts in my latest blog post.

Conroe DWI Trial & the Importance of the SFSTs In a recent DWI trial here in Conroe, Texas where the jury made the right decision and found my client not guilty, I was reminded of a previous blog. In Three Questions to Ask your DWI Lawyer I ...

Montgomery Co. Judge Mark Keough turns himself in for DWI charge

I’ve read a lot of comments of surprise that you can be charged for DWI with Ambien in your system. Almost any intoxicant can be used in charging DWI and happens more often than you think with pills.

abc13.com The charge stems from an accident that happened in September when Keough was driving and sideswiped another driver.

Supreme Court Stays Ex*****on of Texas Inmate Over Issue of Spiritual Adviser

This would be the first ex*****on in Texas since COVID-19 shut down the state. The ex*****on is made even more controversial by the fact that the accused claims he was coerced into confessing and the DNA evidence would exonerate him. His attorney says, "The public interest would be best served by allowing DNA testing to prevent a wrongful ex*****on..."

nytimes.com Ruben Gutierrez’s lawyers argued that he had the right to have a Christian chaplain present during his ex*****on.

Use them wisely. The wrong words to the wrong people could cost you a lot. "I want to speak to my lawyer first" is almost always a safe bet. 🗣

Mental Health & Criminal Defense in Montgomery County

Today is World Su***de Prevention Day. In our latest blog post we offer some local resources and briefly touch on the intersection of criminal defense and mental health. Our thoughts are with everyone that has been impacted by su***de and mental health issues. You are not alone.

conroecriminallawyerblog.com World Su***de Prevention Day raises awareness of mental health issues and some of the consequences of untreated disorders. Oftentimes, these mental health issues intersect with criminal defense. ...

[09/08/20]   Mental health issues and criminal defense often go hand in hand. This week is National Su***de Prevention Awareness Week. Let's take a look at 5 steps you can take when someone you know or love is in emotional pain:

1️⃣ ASK: "Are you thinking about killing yourself?" It's not an easy question, but studies show that asking at-risk individuals if they are suicidal does not increase su***des or suicidal thoughts.

2️⃣ KEEP THEM SAFE: Reducing a person's access to highly lethal items or places is an important part of su***de prevention. While this is not always easy, asking if the at-risk person has a plan and removing or disabling the lethal means can make a difference.

3️⃣ BE THERE: Listen carefully and learn what the individual is thinking and feeling.

4️⃣ HELP THEM CONNECT: Save the National Su***de Prevention Lifeline number (1-800-273-TALK) and the Crisis TEXT Line (741741) in your phone so they're there if you need them.

5️⃣ STAY CONNECTED: Staying in touch after a crisis or after being discharged from care can make a difference. Studies have shown the number of su***de deaths goes down when someone follows up with the at-risk person.

This is a complex and nuanced topic that requires much more than 5 steps, but this is a good place to start. We have some great mental health professionals as followers, what is a quick tip you would give?

Lone Star Community Radio

True crime junkies, here's an interesting show on local Lone Star Community Radio. Today they talk about the homicide of Jerry Denslow in Montgomery County. The defendant, Brian Lee Winterbauer, pled guilty to 40 years TDCJ for Murder and the charge of Capital Murder was dismissed - in this particular case eliminating the possibility of the death penalty.

Jerry Denslow was a 50-year-old man that was about to move to be with his family. Jerry's home was on the market when his realtor could not get in touch with him. The realtor came to the house to find a disturbing scene and Jerry murdered. Host Dan Zientek and Co-Host Paul Hahs were both detectives that were involved in the case and will explain the details of the murder and the investigation leading to the arrest of the suspect. Unlike other true crime shows Dan and Paul were on this scene, they worked the case and have the inside details as to the events of the investigation as they unfolded.

As a UT alum, this anniversary cuts particularly deep. Fifty four years ago today, "before 9/ 11, before Columbine, before the Oklahoma City bombing, before 'going postal' was a turn of phrase, the 25-year-old ushered in the notion that any group of people, anywhere—even walking around a university campus on a summer day—could be killed at random by a stranger."

texasmonthly.com At 11:48 a.m. on August 1, 1966, Charles Whitman began firing his rifle from the top of the University of Texas Tower at anyone and everyone in his sights. At 1:24 p.m., he was gunned down himself. The lives of the people who witnessed the sniper’s spree firsthand would never be the same again.
