ARE YOU A LEADER IN THE AGRICULTURE SECTOR? WELL, THERE IS A NEW PROPOSED RULE FROM DOL YOU MIGHT WANT TO WATCH FOR: The U.S. Department of Labor (DOL) has proposed a new rule to enhance protections for farm workers on H-2A visas. This rule aims to prevent retaliation against these workers, improve worker self-advocacy rights, increase transparency in foreign labor recruitment, and bolster DOL enforcement. Key provisions include immediate implementation of new wage rates to ensure timely payment for agriculture workers, clarifying the criteria for terminating workers "for cause," and facilitating labor unions' contact with H-2A workers.
Additionally, the proposed rule requires seat belts in vans used for transporting workers, addressing transportation safety, a leading cause of farm worker fatalities. It also strengthens the right to organize for workers not covered by the National Labor Relations Act, ensuring labor organizations can communicate with workers and attend meetings that could lead to discipline.
The public can provide comments on this proposed rule for 60 days after its publication in The Federal Register. These reforms are designed to protect vulnerable H-2A farm workers, empower them to advocate for fair treatment, and uphold labor standards without undercutting domestic farm workers. The proposal seeks to improve labor protections for foreign guest workers in the U.S. agriculture industry.
