The People's Justice Council's mission is to engage and equip communities with tools and access to build power from the grassroots up for change at the community level. These are some images of a community located in northern Birgminaham, AL. This black community is the birthplace of the Mayor Randall Woodfin. This community is surrounded by industrial pollution. Local organizations like PANIC People Against Neighborhood Industrial Contamination and GASP are fighting for the health and wellbeing of the residents here. Why are these communities at the bottom of the list of care? Environmental devastation is happening for them now! Poverty and pollution should not be their birthright. We need policy that protect the overlooked and underserved. There is not wait for our communities. We need justice now! Please support their efforts in this giving season.

Today is #ToxicTuesday. This week's featured toxin is Arsenic, an extremely dangerous toxin that when combined with other elements creates a powder that is odorless and colorless. It is classified as a human carcinogen, meaning exposure can cause cancer and other detrimental health problems. CHEJ is working with the group PANIC People Against Neighborhood Industrial Contamination to combat manufacturing plants exposing this dangerous toxin to their community.

On Saturday, July 11, 2020, many environmental groups and activists had created a list of demands to the City of Birmingham, Jefferson County, and the State of Alabama to follow. One of those demands was for the passing of an environmental ordinance to include the establishment of the Environmental Justice Commission. Keith had created a rough draft of that ordinance for your review. If there are any suggestions, critique, ideas, and tweaks that need to be made, please feel free to download the document and do so. We cannot wait for government action. We must force their hand. Keith is looking for everyone who can to join the effort to push for an environmental ordinance to be passed in Birmingham. HEALTH DEPT SEEKS CIVIL PENALITIES AGAINST BLUESTONE COKE

August 11, 2021 Jefferson County, AL — On Tuesday the Jefferson County Department of Health filed a Complaint in the Circuit Court of Jefferson County against Bluestone Coke. The Department is seeking civil penalties and injunctive relief under the Alabama Air Pollution Control Act of 1971 (the “Air Pollution Control Act”) and the Jefferson County Board of Health Air Pollution Control Rules and Regulations (the “Regulations”). The lawsuit relates to Bluestone’s violations of the Air Pollution Control Act and the Regulations at Bluestone’s coke production facility in the North Birmingham community of Birmingham, Alabama. In addition, the Department has issued a formal denial of Bluestone’s permit. “Our health department believes it is critically important to enforce and ensure compliance with the Air Pollution Control Act and the Board’s Rules and Regulations, which are in place to protect the public’s health”, says Dr. Mark Wilson, Jefferson County Health Officer. The Department declined to renew Bluestone’s permit based on Bluestone’s inability to operate its machines and equipment in compliance with the Regulations.

A couple years ago GASP intervened in a consent decree between Jefferson County Department of Health, EPA, USDOJ, and Drummond regarding ABC Coke’s illegal benzene emissions. We recently entered into a settlement agreement with the health department and Drummond requiring many things, including that all settlement funds awarded to JCDH go into an advised fund at the Community Foundation of Greater Birmingham for grants benefiting the public health of impacted communities.

GASP Achieves Significant Improvements to ABC Coke Consent Decree

GASP has reached a settlement agreement with Drummond Company and regulators to address ABC Coke pollution. Drummond is now required to follow a Leak Detection and Repair (LDAR) program for the rest of the plant’s existence.

The settlement requires the Jefferson County Board of Health to put its share of the civil penalty ($387,500) into a fund at the Community Foundation of Greater Birmingham instead of the Health Department's coffers. Those funds will be restricted to projects benefiting the public health of communities near the ABC Coke plant, including Tarrant, Inglenook, and parts of North Birmingham.

The settlement also requires Jefferson County Department of Health to upload all formal reports related to ABC Coke to its website — as well as all files regarding other permitted industrial facilities and sources throughout Jefferson County — within nine months of the entry of the agreement.
