Update: Update: On February 21, 2024, the Court issued its order fully and finally approving the Settlement. Distribution of Settlement payments is estimated to begin on April 8, 2024. On July 21, 2023, the Court entered an Order Granting Plaintiff’s Unopposed Motion to Extend Deadlines for Certain Class Members and Continuing Final Approval Hearing. On August 16, 2023, the Court entered an Amended Order which corrected a typo in the final approval hearing date. The Amended Order is available on the settlement website portlandcompostclaims.com. The Final Approval Hearing will be continued on January 12, 2024 at 2:00 p.m.

The lawsuit alleges that Dean Innovations, Inc. (“Deans”) violated certain laws by selling planting mix and other compost products that may have been contaminated with Clopyralid, an herbicide. Deans mixes certain compost and planting mixes with materials sourced from Yamhill County Mushrooms, Inc. and Organix Inc. (collectively with Deans, the “Defendants”). The Defendants deny any wrongdoing and have asserted various defenses that they believe are meritorious.
