Apple released the AirTag last year - a small coin-sized bluetooth device that you can use to keep track of things that get easily lost, like a purse, bag, wallet, or cell phone. However, some are using them to keep track of people.
Police records are showing that people are secretly putting an AirTag in someone’s car, clothing, or bag to track them without their knowledge or permission. Many of the people doing this are intimate partners or exes.
Strangely enough, the NYS Penal Law might not criminalize this behavior. Stalking charges in NY require a “course of conduct”. Unlawful surveillance only applies to taking pictures or videos. How would you feel if you found one of these in your jacket pocket and did not know who put it there?
911 operators, police, hospital staff, fake 'treatment centers', falsified MRIs, one hundred million dollars of fraud, all were involved in this scheme.
Genuine victims of car accidents were targeted and duped into going to certain doctors and lawyers. These patients, who truly needed medical attention, had their cases 'padded' in ways that didn't help their recovery. The corrupt lawyers, doctors, and civil servants got paid at the expense of our high insurance premiums.
The patient always has a choice. You can shop around and choose the medical professionals and lawyers that you're comfortable with.
Politico incorrectly published that Justice Sotomayor was spotted out having dinner with Nancy Pelosi and Chuck Schumer on the same day that the Supreme Court took oral arguments on vaccine mandates and masks. Justice Sotomayor, who is a type 1 diabetic, has opted to continue hearing oral arguments virtually because of her health condition. The person in the photo, turns out, is Chuck Schumer's wife. Justice Sotomayor was nowhere near this restaurant - perhaps because she was researching how many kids were hospitalized with covid (not 100,000).
This happened with the DA, the Police Commissioner, and against a 20 year veteran of the police department. Yet it's reported as 'unprecedented'.
This absurdity is called ClickWrap, meaning that you have no choice but to accept the terms and conditions if you want to use the software or app. No one reads it and lawyers spend hours and charge plenty of money writing this to cover the butts of the companies behind them.
BTW, most of what you give away in these agreements is the privacy of your phone. The company wants access to all of your phone use and related data. Then they sell it to other companies or give it to governments that ask for it.
My answer as to why to vote? Exit polls. Politicians will cater to whichever demographic or constituency comes out to vote in consistent numbers. That's why unions & religious groups get local attention. If we, as a group, don't vote consistently, politicians won't see us.
I'd like to read the actual statue. It sounds nice in theory, but proving a charge like this is going to be hard.
Plus, it might infringe on constitutional rights strangely enough. Does someone have the right under freedom of speech to say 'I'm going to get your deported'?
Brokers or agents may offer less expensive premiums by removing important coverages without telling you. A good broker will offer you options and let you choose. A bad broker will sell you a bogus policy and then you'll end up needing a lawyer.
The most insidious information we learned was not just about the actions of one man, but the culture of enabling and assisting by the people around him. Many people close to him knew what was happening and helped him do it.
These are not rookie mistakes or single instances of bad judgement. These are people at the height of power, with decades of experience, using their clout and connections to cover for their friends at the expense of justice for victims.
Defense Attorney in NYC and Long Island

Friday sweets from for the office. I like to feed the staff and want clients that drop by! Have a good weekend! But if it's a bad weekend because you got hit by a truck, call me! 631-232-3378.

Instead of a ticket, a cop will now give you a voucher to pay for minor repairs such as broken headlights. The Lights On program is meant to help improve the relationship between the PD and residents. Does it also unfairly incentivize the wrong mentality? Can a police officer still give you a voucher but search your car?

Are you being iStalked?

What do you get when a cop, a doctor, and a lawyer walk into a courtroom? In NY, you get a conspiracy to commit massive fraud. This isn't a joke - a federal indictment rounded up 13 conspirators.

NO FACE NO CASE

Law enforcement & the DA's Office applied for a wiretap warrant based on lies, got a judge to sign off, listened to and recorded conversations beyond what was authorized by the court order, and then used that info to directly threaten a detective with criminal charges. That detective, under oath, admitted to his guilt in open court.

Why vote? There's literally no choice for most of these positions. The candidates run 'crossed endorsed' in most of the elections I voted for today.
My answer as to why to vote? Exit polls. Politicians will cater to whichever demographic or constituency comes out to vote in consistent numbers. That's why unions & religious groups get local attention. If we, as a group, don't vote consistently, politicians won't see us.

I see this too often - a married couple going through a bad divorce, and one spouse threatens the other spouse by saying that they'll report them to ICE to be deported.
I'd like to read the actual statue. It sounds nice in theory, but proving a charge like this is going to be hard.
Plus, it might infringe on constitutional rights strangely enough. Does someone have the right under freedom of speech to say 'I'm going to get your deported'?

Getting cheap insurance has consequences. It's all good as long as you never need to use it.
Brokers or agents may offer less expensive premiums by removing important coverages without telling you. A good broker will offer you options and let you choose. A bad broker will sell you a bogus policy and then you'll end up needing a lawyer.

Robert Kelly was found guilty of all 9 counts. All charges had to do with the s*xual exploitation of women, some of which were underage girls.
The most insidious information we learned was not just about the actions of one man, but the culture of enabling and assisting by the people around him. Many people close to him knew what was happening and helped him do it.

Drunk Boating is a crime. Plus it's dangerous. Boating accidents can be just as disastrous as car accidents.

Former District Attorney Thomas Spota and former Suffolk Chief of Investigations Christopher McPartland have been convicted of corruption related felonies and sentenced to 5 years in prison. Former Georgia District Attorney Jackie Johnson was just indicted for interfering in the investigation of the murder of Ahmaud Arbery. She is accused of directing the police investigation away from the defendants.
These are not rookie mistakes or single instances of bad judgement. These are people at the height of power, with decades of experience, using their clout and connections to cover for their friends at the expense of justice for victims.

Devesh was about to start his freshman year of college. His parents were in town to send him off to school. He went out to a house party in East Hampton when he was struck and killed by a driver who left the scene. The driver was eventually found and charged with the felony crime of leaving the scene of an accident resulting in death. This tragedy is heart wrenching.

But, what did the prosecutor do to provoke the judge?

Interesting...

I'll be live talking about criminal and immigration law today at 6pm

Another motion to dismiss a criminal case granted!
The new speedy trial laws in New York State are much more favorable to people accused of crimes. The job of the district attorney now is to turn over all evidence as soon as possible. Not only that, but they must verify with the court in writing that they've done so. If they don't, the charges can get tossed just like in this case.

I'm sitting in arraignments. There's an attorney in front of me that is currently a Village Court Justice and a traffic court judicial hearing officer. She's talking to another lawyer and bragging about suspending people's licenses in traffic court. These two lawyers had a good laugh about traffic court 'trials'.
Good news is that I'm getting my client's cases dismissed today.
I think judges should have to pass a judge test instead having to be put up by a political party for a phony election.

Drag racing is a crime in NYS. It's also an avoidable cause of car accidents, many of which are fatal. I think having legal and regulated drag race events would reduce the amount of illegal ones from happening.

If you were in a car accident, these officers would contact a specific tow company that would probably rip you off and take your car to a the mechanic they wanted.
You can contact any tow company you want and to have your car taken to your mechanic of choice.
These same cops sold your name and phone number to disreputable lawyers and medicals mills. That's why people get soliciting phone calls after an accident even when they never wanted them.
Similarly, you can go to the medical facility of your choice as long as they accept No Fault insurance.
These same cops were acting as private armed security for drug traffickers.

charges will no longer be a thing in Manhattan. The DAs Office won't prosecute people charged with this offense even if the police arrest them.
Other district attorney's offices in New York City are looking to do the same thing.
Years ago, the NYDAO did something similar with ma*****na and the New York State legislature eventually legalized it.
Does this make prostitution legal? No. Does this mean that the people paying for s*x services won't get in trouble? Also no. Finally, s*x trafficking charges, which includes pimping and forcing people into a lifestyle of s*x work, will remain enforced.

Why is this 99 Honda Civic a Total Loss but this Lambo is not? Total Loss does not mean what you think it means.
Your insurance company says a "Total Loss" is when it costs more to fix it than to buy it. How does the insurance company value your car? They used to go by blue book value or something similar. Now, most companies go by comparable sales of similar make, models. and conditions over the last 6 months in your area. The insurance company won't pay more to fix something when theoretically you can buy the same item for less money.
While the Honda might be able to drive and the lambo cannot, a '99 Honda has a street value of a few hundred dollars and the Lambo has a value of a few hundred thousand dollars. That's why the Honda is a Total Loss with much less damage than the Lamborghini.

Who else used to furiously tap out emails on this for work?

Why speed limits? During WW2, they were to help conserve gas and rubber. In the 70's it was to conserve gas again due to the shortage from the oil embargo from the Middle East. Statistics don't support fuel economy, but the numbers are irrefutable for safety - speed limits save lives and raise money for the government (tickets!)
Tiger Woods' accident was caused by his excessive speed combined with the winding road.

NYS just legalized ma*****na (with restrictions like alcohol or ci******es).
Will this increase crime? Oregon, Colorado, and Portugal are examples indicating not likely in the long run.
Will this increase car accidents? Historical use of alcohol indicates yes, it most likely will.
Can this lead to mental health issues? Experts in the area say yes, anyone with previous history or Uber 25 can suffer psychotic breaks

How did I miss this? is NOT a phrase I've heard often, and never as a compliment to a female lawyer. I've been in his courtroom before, and I'm almost disappointed he did not compliment me with similarly profound words.

What is constructive possession? This guy is about to find out. Rapper NLE Choppa - along with two other people - were found in a car with two guns allegedly. All three of them were arrested on possession of a firearm. How can three people be arrested for possessing the same two guns? That is constructive possession. The police will have probable cause to arrest but the prosecutor will need more evidence to prove their case beyond a reasonable doubt. Hopefully won't make a rap song confessional...

Nassau County and Suffolk County Police have received some highly critical press recently.
The NYT details how the Suffolk County PBA has defied attempts at police reform and has bargained one of the highest salaries for the police in the US. This all while the former police chief James Burke went to jail in 2016 for, among other crimes, assault and obstruction.
Nassau County police have their own article detailing fraudulent charges and lies by police officers. Video evidence later exonerated the innocent people those officers arrested.

Don't go cheap with your auto insurance. If it's too good to be true, it is. If you buy cheap insurance, you'll get minimal coverage. You'd be surprised how little it costs to get larger limits or added benefits. Ask my friend Ben over at

I would like to represent this man.
Using the center turning lane to pass another vehicle on the left is not permitted. Had this BMW caused an accident, the driver would be 100% at fault for car damage.
Also, as dash cams become more ubiquitous, many frivolous claims are going to disappear.

When you use AncestryDNA, 23andMe, or MyHeritage, you might be opting in to allowing law enforcement to use your DNA without a warrant.

What's the deal with the Dr. Seuss?
Is cancel culture going too far?
These are the controversial images in the books. Take a look and judge for yourself. Two things to keep in mind: 1) Dr. Seuss' books aren't just for kids, but kids are the primary readers, and 2) Dr. Seuss also draw political cartoons for adults

'He hit me! Why should I have to pay for my medical bills?'
The answer is NY's No Fault law. It has some good, some bad, and plenty that can get complicated. Contact me for a free evaluation and I can explain the entire No Fault prices to you.

How did I spend MLK Day? I took 5 hours of Continuing Legal Education classes to keep my skills sharp. I gave my staff a paid day off, but I got in early to keep my office running. I also processed a settlement check for a happy client :)

for tickets, real or not? I think they are, but I've heard others deny it.
