Welcome back to Episode #3 of saving a home from foreclosure.
A brief summary of this transaction - Seller dies without a will. Not married. No kids. She has two sister. Both sisters inherit, then one sister dies a few months later. Title search comes back and there are 13 judgments to clear up. Some are against the original owner, some against the deceased sister and some against the sister who was still living. What information does a title company need to get this to closing? How can a title company get payoffs especially when some of the original creditors no longer exist?

If you’re buying or selling property, or just reading the news, you know that there’s a tight market right now due to lack of inventory. However, I can tell you that contracts are getting ratified, and you can still have contingencies attached - home inspection, financing, and appraisal. While houses are still selling over list price, the final sales price is ranging between $5,000 and $30,000. Here is a snapshot of 10 ratified contracts that I recently received.

In acknowledgment of Star Wars Day we asked Chatgpt to reimagine Marcus Simon’s recent post on HOA’s in the inimitable style of Darth Vader.
I have received this question several times this spring, and it is your destiny to receive a quick post. Do not exert yourself attempting to force your HOA to generate or furnish documents they do not possess merely to disclose them to your buyer.
Many listing agents believe that unless they can obtain a disclosure packet (soon to be referred to as a resale certificate as of July 1) from the HOA, the buyer's right to cancel may be extended up to the closing date. They overlook the fact that the HOA Act allows you to start the three-day countdown by delivering a packet or providing notice that the resale package is unavailable.
For the purpose of clause (iii), the association disclosure packet shall be considered unavailable if (a) the association has not filed a current annual report with either the State Corporation Commission under § 13.1-936 or the Common Interest Community Board under § 55.1-1835, (b) the seller has made a written request to the association for the packet, and no packet has been received within 14 days in accordance with subsection A of § 55.1-1809, or (c) the association has provided written notice that a packet is not available.
Therefore, if you ask the President of the local HOA for a package, and he replies in an e-mail saying "we don't have one," or if 14 days pass and you do not receive one, or you discover that the HOA stopped filing their reports with the state years ago... prepare a Sales Contract notice that states: "Pursuant the Property Owners Association Act § 55.1-1808, the association disclosure packet will not be available." And deliver it to the Buyer with your ratified contract. This commences the three days and is much less effort than attempting to persuade the Board to perform their duties.
It occurs frequently, and the power of the dark side makes it an option with HOAs.
📢 BREAKING NEWS 📢
HB 1888 was recently signed into law by Virginia's Governor, after it was passed by Virginia's House and Senate with a UNANIMOUS vote. In today's world, if a law passes unanimously, then you can take it to the bank that it is firmly established jurisprudence.
The new language added to Virginia's Choice of Settlement Agent statute reads: "The settlement agent may not collect any
fees from a represented seller payable to the settlement agent or its subsidiaries, affiliates, or subcontractors without first obtaining the written consent of the seller's counsel." This language will now appear in every real estate contract across the Commonwealth, beginning July 1.
This new law is a Consumer Protection measure, aiming to assist Virginia homeowners by keeping their settlement costs down during the closing on the sale of their home. In the recent past, some bad actor Settlement Agents had established a practice of forcing represented Sellers (Sellers who chose an attorney to handle all communication and coordination of their side) to pay the Settlement Agent's settlement fees on top of the legal fees that the Seller was paying their attorney. And, the worst aspect of this forced fee placement by these Settlement Agents was that the fees were for no discernable service being provided to the Seller.
So, now, with this language, a represented Seller's attorney will be able to dictate to the Buyer's chosen Settlement Agent what fees the Seller will be willing to pay, if any, for any service being provided. In summary, the represented Seller will be given the opportunity to consent to any fee being charged by the Settlement Agent. This consent is based soundly in logic and reason, which unfortunately had been dismissed by some settlement companies over the past few years in their quest for higher profit.
