I have a question regarding criminal charges arising from a civil matter already filed in civil courts by the defendants accusing the plaintiffs of trespassing on a property already in dispute by both parties. where the high court has already issued an interim order against defendants and all of sudden defendants becomes complaints in the same dispute.kindly I need to be educated on the matter as a lay person.

THE EAST AFRICA ASSOCIATION OF PROSECUTORS’ CONFERENCE 2021.

The East Africa Association of Prosecutors (EAAP) will hold its 9 th Annual General Meeting (AGM) and an Eastern Africa Prosecutors’ Conference themed “Combating Wildlife Crime as an Economic/Organised Crime in Eastern Africa.” The Conference and AGM are hosted by the National Prosecution Services of Tanzania (NPS) in collaboration with TRAFFIC East Africa through the support of the USAID funded-Conserving Natural Capital and Enhancing Collaborative Management of Natural Resources in East Africa (CONNECT) Project, Space for Giants, the United Nations Office on Drugs and Crimes (UNODC), and African Wildlife Foundation (AWF).

The duo have rendered excellent service to the Office of the DPP.
Congratulations to them!

Today 19th August 2021, DPP Jane Frances Abodo met officials from the United Nations Office on Drugs and Crime (UNODC), to discuss issues of technical assistance by the UNODC to the Office of the DPP, on preventing and countering Transnational Organized Crime, Illicit Trafficking and Terrorism.

The UN officials were led by Mr. Johan Kruger, Head of Transnational Organised Crime, Illicit Trafficking and Terrorism Programmes for Eastern Africa.

In attendance also was Ms. Sharon Lesa Nyambe, Head of Office, UNODC Office in Kampala, Solomon Masitsa, Associate Programme Officer, UNODC Kenya, Mr. Vincent Wagona, Deputy Director of Public Prosecutions, Ms. Rachel Bikhole, Assistant DPP/Head, Anti-Trafficking in Persons Division among others.

The meeting was held to ensure increased and effective prosecutions of Transnational Organized Crime, Illicit Trafficking and Terrorism.

Mr. Johan Kruger took the opportunity to present the Nelson Mandela Rules to the DPP.

The Court of Appeal has today 29th July 2021 delivered its judgment in the Pension Case involving Jimmy Lwamafa and others.

The panel was constituted of Justice Catherine Bamugemereire, Justice Muzamiru Mutangula Kibeedi and Justice Remmy Kasule.

The appeal originated from charges by the Office of the Director of Public Prosecutions against Lwamafa Jimmy, Kiwanuka Kunsa Stephen, Obey Christopher and Bob Kasango for the diversion of public resources, conspiracy to defraud, theft, and forgery of a judicial document. The quartet were duly tried before Lady Justice Tibulya Margaret at the Anti-Corruption Division of the High Court and convicted and sentenced to various terms of imprisonment. A1 and A2 were ordered to compensate the Government jointly a sum of Ug. Shs. 3,495,680,660.

Dissatisfied with the decision, the appellants lodged an appeal in the Court of Appeal.

The Court ruled in their abridged judgement that following the demise of Christopher Obey and Bob Kasango, their criminal appeals had abated. The Court of Appeal further decided that its wrong for a Trial Court to employ both consecutive and concurrent sentences as it shows confusion in their ex*****on. The sentences passed against Lwamafa Jimmy and Kiwanuka Kunsa Stephen by the Trial Court were upheld and to be served concurrently. The orders for compensation and bar to holding public office were similarly upheld.

The appeal was argued for the state by Ms. Josephine Namatovu, Assistant DPP and Head of the Anti-Corruption Department. She is commended for successfully defending the convictions and sentences. #ODPPUGANDA #ODPPCOURTUPDATE
