รู้หรือไม่ ผู้ส่งออกธรรมดาก็ขอคืนภาษีได้ !?

ตามพระราชบัญญัติชดเชยค่าภาษีอากรสินค้าส่งออกที่ผลิตในราชอาณาจักร พ.ศ.2524 ระบุไว้ว่าผู้ส่งออกที่ยังมิได้รับสิทธิประโยชน์ดังต่อไปนี้

1. ผู้ได้รับสิทธิBOI
2. เขตประกอบการเสรี
3. พ.ร.บ.ศุลกากรตามมาตรา29 (19ทวิ เดิม)

โดยจุดประสงค์ของพ.ร.บ.ฉบับนี้ คือ เพื่อเป็นกานลดภาระต้นทุนจากภาษีทางอ้อมต่างๆเช่นค่าน้ำ ค่าไฟฟ้า และส่งเสริมการส่งออกของผู้ประกอบการที่ใช้วัตถุดิบภายในประเทศ(จะเป็นบริษัทเจ้าของคนไทยหรือต่างชาติก็ได้ และผู้ส่งออกไม่จำเป็นต้องผลิตสินค้าเอง/ล้งส่งออกผลไม้ก็ขอชดเชยอากรได้นะ) โดยชดเชยในรูปแบบของ”บัตรภาษี”
โดยมีทั้งหมด4แบบ คือ 100,000 10,000 1,000 และชนิดไม่บอกราคา
ซึ่งบัตรภาษีสามารถนำไปชำระค่าใช้จ่ายต่อหน่วยงานของรัฐได้ทุกหน่วยงาน เช่น ภาษีเงินได้ ภาษีศุลกากรขาเข้า ภาษีสรรพสามิตร เป็นต้น
โดยผู้ส่งออกขอยื่นใบรับคำขอชดเชยค่าภาษีอากร (กศก.123) ภายในระยะเวลา 1 ปีหลังจากวันที่ส่งออก

***บัตรภาษีมีอายุ 3 ปี และขอต่ออายุได้จนถึง 9 ปี***

นอกจากนี้ตามพ.ร.บ.ฯยังให้สิทธิผู้ที่ขายสินค้าให้แก่หน่วยงานราชการ และรัฐวิสาหกิจที่กู้เงินจากต่างประเทศ ซึ่งเร็วๆนี้ทางกรมศุลฯจะทำเป็นระบบElectronicsเพื่ออำนวยความสะดวกแก่ผุ้ประกอบการให้มากยิ่งขึ้น

Why Freight Master ?

ปัญหาที่ผู้นำเข้าพบบ่อยที่สุดคือ... เจ้าหน้าที่ศุลกากรแจ้งว่าผู้นำเข้าสำแดงอากรเท็จ หรือ หลีกเลี่ยงอากร !!!

สืบเนื่องมาจากเจ้าหน้าที่ศุลกากรชี้พิกัดไม่ตรงกับใบขนสินค้าขาเข้าที่ทาง Shipping ได้จัดทำไว้ แม้ว่าเราอาจจะคอนเฟิร์มกับต้นทางแล้วก็ตาม เพราะปัญหาจริงๆแล้วนั้นมาจากการตีความสินค้านั้นมาจากดุลพินิจของเจ้าหน้าที่แต่ละท่าน

นั่นจึงเป็นปัญหาที่ทำให้เราต้องเสียค่าปรับเพิ่มเป็น 2 - 4 เท่า หรือ อาจต้องวางประกันเพื่อนำสินค้าเข้ามาก่อน หรืออาจจะต้องขึ้นโรงขึ้นศาลกันเลยทีเดียว แต่ปัญหานี้สามารถแก้ไขได้ง่ายๆด้วยการ

“ ขอยื่นดูพิกัดก่อนที่จะนำเข้าสินค้านั้นเลย ”

ซึ่งเราสามารถทำในระบบออนไลน์ง่ายๆได้ในเว็บไซต์ของกรมศุลกากรโดยแนบข้อมูลสินค้าที่จำเป็น อาทิเช่น รูปภาพ แคตตาล็อก คู่มือ และ ใช้เวลาไม่เกิน 30 วัน โดยมีค่าใช้จ่าย 2000 บาท ต่อครั้ง ซึ่งเมื่อทางกรมศุลกากรได้ทำการชี้พิกัดแล้ว เราสามารถนำใบชี้พิกัดนี้มายื่นพร้อมพิธีการศุลกากรขาเข้า โดยจะมีอากรที่ต้องเสียระบุไว้อย่างชัดเจน
