Its going to two years without hearing a word ,seeing and feeling any move about Wanhalel organization .

Wanhalel organization is a nonpartisan organization legally registered at RRC as national organization(NGO),working with communities of Bhar El Gazal Region on Customary law review and cultural reforms,girl child education and women empowerment in the region ,Wanhalel encouraged people of the region to engaged in productive activities while continuing with their peaceful coexistence within themselves and neighbouring communities .
In every year ,we are to conduct cultural galas event which is on preparation to showcase different cultures in diversity ,our aims and plans are not limited to peace awareness, promotion of different cultures, girl child education ,productively in the area of agriculture ,women empowerment and Wanhalel conference to review Wanhalel customary and many more, our team are so engaged with communities to make sure some of the projects are implemented .
In this regard ,keep in touch with us for more updates, we are resuming after a long awaited lifting of lockdown due to covid 19 pandemic .

Wanhalel is the area like others places in South Sudan and beyond located in South of Tonj of Bhar el Gazal region,but its unique area laid near River 🚣 bank which pass through Wau to Tonj,Wanhalel upto swampy area of toch .

How did wanhalel came to inked on papers πŸ“‘and different books πŸ“š in South Sudan?

In April 1976 Jieng from greater Bhar el Gazal region decided to have their customary laws where wanhalel Dinka customary laws was made oversight by Late Isaiah Kulang Mabor who was the regional commissioner and late molana Wol Makech was the secretary of the conference,the conference was attended by all executive chiefs,elders and youth drawn from all Jieng sections across Bhar el Gazal region.
All traditional leaders,elders and youth from Agar community,Yirol community πŸ‘₯πŸ‘₯πŸ‘₯,Gok community πŸ‘₯πŸ‘₯πŸ‘₯,Gogrial community πŸ‘₯πŸ‘₯πŸ‘₯,
Awiel community πŸ‘₯πŸ‘₯πŸ‘₯,Twic Mayardit community πŸ‘₯πŸ‘₯πŸ‘₯,Ngok Abyiei community πŸ‘₯πŸ‘₯πŸ‘₯,Marial baai and Tonj community πŸ‘₯πŸ‘₯πŸ‘₯ came together to deliberate on the issues of security and tribal conflicts,more specially customary laws.
The resolution of conference led to the unification and Cordification of the Dinka customary laws in the province that remain workable until today.
The customary law is the stablished pattern of behaviors characters that can be objectively verified within particular sitting.
A claim can be carry out in defense of law,related is the idea πŸ’­of prescription a right enjoyed through long custom rather than positive law.
In relation Jieng communities have long been referring their doubts and laws related problem to wanhalel Dinka customary law,a legal system set up to now and than,because the soures of wanhalel customary law recognition is the community πŸ‘₯πŸ‘₯πŸ‘₯ private rights guiding their custom norms , values and cultures,the authority stick on agreed law and the guilty must be subjected as torts (the private wrongs injuries or crimes while the law is guiding higher authority).

The failure is gradually weakening Jieng legal spirit of togetherness,slowly vansing the entire civilization of Jieng customary law.

Wanhalel Dinka customary was made out of six Dinka social values which includes:-

-Equality
-Safety
-fairness
-loyalty

How did wanhalel Jieng customs and cultural organization came into existence?.

Wanhalel Jieng customs and cultural organization was founded on date 9/7/2017 by a group of Jieng youth from Bhar el Gazal and upper Nile Jieng who felt to come together as one legal community on customary laws and cultures.
It's the non political organization open to ever Jieng citizens as its the social forum that bring all Jieng in practicing their customary laws,culture and language πŸ‘„πŸ’¬.
It will also serve as link πŸ”—of connection among Jieng members.
Wanhalel customary laws in it entirely is still widely used todate,but as matter of facts,the post modernism of current habitual progression,requires Jieng customary law to be amended so that the century changes undertaken over the years can have the proper laws to guide their newly adopted crimes and emergency of distinctive habitual flows of ideas,doubts,the newly crimes adopted.
But,since wanhalel customary law cover the entire region of Bhar el Gazal only,the body will work hard to create Inclusivity and diversity of other Jieng in Upper Nile region.

Purpose of this organization

-To establish Jieng regional customary laws center
-To let unwritten law be discussed under Jieng elders and chiefs as legislative acting of the state.
-To amend customary laws

-To advocate for girl child education πŸŽ’πŸ«πŸ“šπŸŽ“and adults education
-To work toward gender equality and women 🚺empowerment
-To provide center for training cultural exhibitions and research on Jieng customs,norms and values.
-To organize,conduct program on health,education and agriculture through capacity building
-To coordinate developmental project to the communities.

-18/9/2018 the organization certificate was launched and cultural gala commenced and keys speakers spoke on Jieng customs,norms and values .
-organization has owned it flot of land as organization premise,since organization have not yet built it office 🏒,we have our office 🏒at Nyakuron cultural center for time being and we will relocate to our main office 🏒 .
-the organization is also working closely with cultural groups to support them materially with cultural materials to boost activities of the cultures of various Jieng.

Workplan
-Organization is currently seeking funds to dispatch research committee to Bhar el Gazal and Upper Nile respectively to go and collect relevants informations from the people at the grassroots.
-this research also will be part of peace and reconciliation among Jieng communities.
-after research,all datas will be combined and big conference will be organized in Juba than back to the states where the amendment of customary law will comment.
-norms,values and cultures will remain as our major roles which will be collective.
-the organization body will be expanded across Jieng sections.
-all others objectives mentioned above will follow to served our communities.

UPDATE: An Overview of the Legal System and Legal Research in the Republic of South Sudan - GlobaLex

Know your legal system: the Judicial System in South Sudan
South Sudan has dual judicial systems consisting of statutory and customary law courts. Both systems operate concurrently, and in a parallel manner at urban and rural levels respectively. The formal Courts follow the principles laid down in the statutes in their disputes resolutions while Customary Courts rule according to the customary laws of their respective ethnic groups.
The relationship between two court systems is often unclear. Although customary courts are subordinate and answerable to statutory courts, they are more closely linked with the executive branch than to judiciary as they are established and regulated by the Local Government Act and are administered by the local governments at the county level. This has undermined the capacity of the formal courts to monitor and supervise the judicial functions of the customary courts.
The South Sudanese judiciary faces substantial challenges in delivering justice. Upon coming into force of the constitution, South Sudan adopted English as the official language and common law as its legal system. It is pertinent to note that majority of the present judges and lawyers in South Sudan were trained in Arabic language under old Sudan’s sharia based civil law system.
They therefore lack language skills to practice in English. This has undermined judiciary’s ability to deliver justice. A study by the International Commission of Jurist has also noted the lack of uniform legal practice in the country.
Court Structure
The Supreme Court
The Supreme Court located in the capital Juba is the apex court and custodian of the constitutions and state constitutions. It consists of a Chief Justice, his deputy and five other justices. Its decisions are final and binding on all courts, including customary courts. The court is vested with exclusive and original jurisdiction to adjudicate on any legal disputes arising either under Transitional Constitution of the Republic of South Sudan or state constitutions.
Other jurisdictions include review and cassation in respect of any criminal, civil and administrative matters arising out of or under the law, interpretation of laws and the power of Judicial review. The Supreme Court sits in panels of three justices on each matter except on constitutional issues when quorum of not less than nine judges is required. Their decisions, taken by majority, are final and binding.
There is a problem with the composition of the Justices of the Supreme Court. Whereas the Supreme Court consists of a Chief Justice, his deputy and five other justices, the Quorum required to deal with constitutional issue is nine. The question is where do we get other two justices as full bench are seven?
The Court of Appeal
The Court of Appeal is the second highest court in the country. It consists of President and four other justices. There are three branches of the Courts of Appeals located in Juba, Malakal and Rumbek. They take appeals from the high courts and their decisions can be appealed against before the Supreme Court.
6.3 The High Courts
There was High Court in each of the ten states of South Sudan up to 2015. However, with the recent expansions of states from ten to thirty-two, there are at least twenty-two states without High Courts. High Courts are vested with exclusive and original jurisdiction over all murder cases and hear appeals from the County courts.
6.4 The County Courts
These are lower courts below the High court in each county. As of March 2018, few County Courts have been established. Similarly, with the expansion of states, it is not clear how many counties have been established so far given that the creation of counties is a going on process. According to the Code of Criminal Procedure, County Courts enjoy original jurisdictions limited to criminal cases that carry sentence with not more than seven years imprisonments and fine not exceeding 5000 SSP. The constitution leaves room for the establishment of more courts or tribunals when deemed necessary.
6.5 The Customary Courts System
The Transitional Constitution recognizes the customary law courts, the institution and role of traditional authority. The Local Government Act of 2009 formally established the customary law courts. These courts that are presided over by traditional chiefs and decide cases according to customs, norms, traditions and ethics of their respective communities.
As they are quick and more easily accessible than Statutory Courts, an estimate of more than 90 percent of disputes in South Sudan are handled by them. According to Section 98 (2) of the Local Government Act of 2009, Customary Courts do not have jurisdiction over criminal matters except for those cases with customary interface and only after having been referred by Statutory Court.
However, the Act does not define the criminal cases with a customary interface. Consequently, they hear all kinds of cases including homicide that clearly fall outside of their jurisdictions. The local Government Act 2009 departed greatly from Chiefs' Courts Ordinance of 1931 which vested the customary courts with full jurisdiction over criminal matters.
Customary Courts occupy an important place within the legal system of South Sudan. During the North-South civil war, customary law was the primary source of social order and stability within the southern region. Customary law reflects the traditions and the customs for which the South Sudan struggled for decades to secure.
While Customary Courts play an increasingly important role in the legal system of South Sudan, their procedures and rulings are often inconsistent with basic human rights principles. Practices such as compensation of murder with exchange of a girl child and holding relatives or members of a clan collectively responsible for a crime of individual clearly violates international human rights law.
The basis of customary law has always been to achieve reconciliation and harmony within the community; however, it often does this at the expense of women and girls. Although the Local Government Act provides for representation of women within customary law courts, in reality, it is hard to find female chief making up the bench in the customary law courts. It is therefore not surprising that women are less likely to get justice in case of violation of their individual rights.
The Local Government Act provides four levels of the customary law courts. [β€œC” courts at the county level are the highest courts and receives appeals from β€œB” courts. β€œB” courts are at Payams level with only jurisdiction up to a maximum penalty. The Town Bench courts with competence of β€œB” courts at town level. Their decisions are appealed against before County Judge of the First Grade. The last are β€œA” Courts at Boma level that mainly deal with family and marital issues.

Jurisdiction means the power of Courts to handle certain cases based on either their gravity in case of criminal law or pecuniary value in case of a civil case.
