Are you enjoying your weekend?

As an employee, you are entitled to a weekend holiday of not less than twenty four consecutive hours. The weekly rest may either be on such day as is customary (Saturday or Sunday) OR on a different day as agreed between the employer and employee.
(Section 59 of the Labour Act, 2017)

Insurance Tip

Is your vehicle comprehensively insured? And have you unfortunately been involved in a motor accident? The following are some standard documents required by an insurance company to process the claim;

1. Vehicle Log book.
2. Driver’s permit.
3. Repair quotations.
4. Traffic Police Report.
5. Witness statements.
6. Duly filled claim form.

NB; Immediately report an accident to the insurance company by way of telephone, email or word of mouth, in accordance with the Notification Clause of the Insurance contract.

هل يمكن تنفيذ العقود المبرمة شفهياً/شفاهة؟ هل يمكنني استرداد اموالي اذا تم خرق عقد ابرمته شفهياً؟ ام هل سأحتاج إلى إثباته بعقد مكتوب؟
تنص المادة '٤٣' من قانون جنوب السودان للعقود لعام 2008م على ما يلي:
قد يكون العقد شفهياً أو مكتوباً او شفهياً جزئياً و مكتوباً جزئياً او قد يكون ضمنياً من خلال سلوك الأطراف.
لذا، يمكن استرداد اموالكم لخرق العقد سواء كان شفهياً او مكتوب. مع ذلك ننصح بتقليل العقود الشفهية و تبديلها بعقود مكتوبة و ذلك لسهولة إثبات الاخير.
ملاحظة: العقود مثل الرهن العقاري و عقود التأمين و الضمان يجب أن تكون مكتوبة.

Is a verbal contract enforceable? Can I recover my money for breach of a contract that I made by word of mouth? OR do I need to prove an agreement by producing a written contract?

Section 34 of the South Sudan Contract Act, 2008 provides; A contract may be oral or written or partly oral and partly written or may be implied from the conduct of parties.

So, you can recover your money for breach of contract that was either by word of mouth or written form.

However, endeavor to reduce contracts into written form. They are easier to prove.

NB; Contracts such as Mortgage Deeds, Insurance Contracts and Contracts of Guarantee have to be in writing.
