Your Chair penned the Resolution denying the application for TRO of Senator Dela Rosa. It is a brief and succinct read (even shorter than some of the dissenting opinions).

If there is an essential requisite to an application for a TRO, it would be a clear and unmistakable right. Without it, every other element would clearly be not present.

Here, the Court ruled that Bato’s purported rights are CONTINGENT to the resolution of the main case. This means, there are no clear and unmistakable right that merits protection of a TRO.

And as the SC already clarified, the main case is still pending and is to be ruled upon.

'DELA ROSA HAS NO CLEAR AND UNMISTAKABLE RIGHT TO BE PROTECTED'

Sen. Ronald “Bato” dela Rosa “has no clear and unmistakable right to be protected,” the Supreme Court (SC) said in its resolution denying a petition for a temporary restraining order against the senator’s potential arrest under the International Criminal Court (ICC).
