Do you owe your ex for student loan payments?
Most people know that relationship property is usually divided 50/50 after separation.
But student loans are different.
Unlike mortgages, credit cards, or car loans, student loans are usually considered personal debt, not shared relationship debt. That means the person who took out the loan normally remains responsible for it.
However, things can get complicated.
If a student loan existed before the relationship but was repaid during the relationship using shared income, the other partner may be able to ask for compensation.
And in some situations, student loans taken out during the relationship may partly benefit the relationship or family.
It is one of those surprisingly tricky issues that can cause tension during separation.
