We hope that everyone is keeping safe and dry in this awful weather we are experiencing. It may be that some of our staff and partners, particularly those who live remotely, will work from home on Monday 31 May 2021.

When you're in the market to buy a property, you're going to get a fair bit of lawyer jargon coming your way! One of these terms you will hear, is a LIM or Land Information Memorandum. A LIM shows the details of the property including plans, consents, plumbing, water reticulation, gas lines, and other things that might be relevant for the property's land area.

Why is a LIM important, and why should you get your lawyer to look over it? A LIM gives you the 'bones' of the property - how are things supplied to the dwelling, and if there has been any issues with regards to the land. It will also show you any consents granted or, declined - your lawyer will inform you of any issues here, as once you buy the property, it will be considered that your due diligence has been done! If something is un-consented, then its up to you to sort out as the new owner.

A number of announcements were made by the New Zealand Government on Tuesday regarding changes that will take effect this weekend. ๐Ÿก

Sandra Iskander from the team at Kannangara Thomson has written what you need to know!

1) Investors - If you have/ had an agreement for the purchase of a property, that is signed and dated prior to this coming Saturday the 27th of March 2021, then;

a) The current 5 year bright line test applies (which means if you sell a property within 5 years of buying it, you may have to pay tax on the profit you make). However, if your agreement is signed on Saturday or later, this will change to 10 years. Exception to the new 10 year Bright Line - a New build.

b) Your interest deductions will be successively denied over a four-year period. However, if your agreement is signed on or after this Saturday the 27th of March 2021 - Then you cannot have any interest deductions. This essentially means that IRD will consider the Interest paid on your rental loan as income which you will have to pay tax on, instead of it being claimed against your property as a deduction.

2) First Home Buyers - If you purchase a property as your main home, but use it as a rental during the time you own it - say for example if you go overseas for a year and rent it out during that time - you will be subject to payment of tax on any profit you make, when you go to sell it - for the time that you use it as a rental property (The same Bright Line Test rules in (1) above will apply to you in that case).
