Seven days. The bank still hadn't received the application.
Not because anyone was slow. Because four parties were waiting for paper to move through Nairobi.
Routine insurance financing. Forms printed, signed one at a time, scanned, physically moved between offices. One director was in Mombasa. Nothing landed at the bank. Processing hadn't started.
The frustrating part: the legal framework to do this differently already exists. Kenya has recognized advanced and qualified electronic signatures under KICA and the Business Laws Amendment Act for years. The law changed. Businesses have not caught up yet.
And then there's the cross-border version of this problem.
When a Kenyan business signs a contract with a counterpart in Germany or the Netherlands, someone usually ends up emailing a photograph of a pen signature and hoping it holds. A Qualified Electronic Signature under eIDAS is legally equivalent to a handwritten signature across all 27 EU member states. No notarization. No re-certification. It just holds.
What I didn't expect when I looked into this properly: a QES audit trail is stronger evidence than a wet signature. Not equivalent - stronger! It records exactly who signed, when, on which device, with what verification, against a document hash that proves the content hasn't changed. A wet ink signature passed through four offices can't tell you any of that.
We just got used to accepting ink on paper as enough.
