When it comes to matrimonial homes in Ontario, who holds title is only part of the story. 🏡

Ontario’s Family Law Act treats matrimonial homes very differently from other assets. If a property is your matrimonial home, its full value, not just any increase during marriage, must be shared equally between married spouses if they separate. It doesn’t matter whose name is on the title or who originally funded the purchase. Even parents who gift or help fund a property for their child can’t rely on title alone to keep that asset protected from claims by a future in-law.

Unlike other investments where ownership or the name on the deed controls rights, the Family Law Act can override what’s on paper. The equalization regime applies only to married couples, common-law partners do not have the same automatic rights, so this distinction can have major financial consequences at separation.

Having a proper marriage contract or prenuptial agreement is often the only way to align family intentions with legal realities in Ontario real estate. Getting legal advice before major purchases or life changes is a must.
