Risk-Based Complaints Handling: Six Questions to Consider

Not every complaint should be handled the same way. A fair complaints process is not about treating every issue identically, but about responding in ways that are transparent, proportionate, and grounded in risk. In this article, we explore six practical questions organizations should ask when applying a risk-based approach to complaints handling, from identifying potential harm and assessing seriousness early, to deciding who should conduct the assessment and when external support may be needed. A thoughtful risk framework helps organizations use limited resources wisely, protect people, and build trust in the integrity and fairness of their complaint handling systems. With reforms likely coming to Ontario's Rules of Civil Procedure next year, arbitration is a more appealing option than ever. Arbitration allows parties and their counsel to be efficient and to develop and customize the process to their needs. For example, if counsel wish to preserve their right to conduct oral examinations for discovery, arbitration may be the only option beginning in 2026. One of our arbitrators, Barry Arbus [https://adrchambers.com/neutral/barry-s-arbus/], wrote a post summarizing the proposed reforms to the Rules and how arbitration will play a key role in the years ahead.
