Gazumping

Gazumping occurs when an agent or seller accepts an offer you make to buy a property at an agreed price but the property is sold to someone else. This usually happens when the vendor sells the property for a higher amount. The agent is legally obliged to pass on to the vendor any further offers received for the property up until the exchange of contracts.

In NSW, a property sale is binding on the seller and buyer when contracts are exchanged between the two parties. Exchange occurs when the seller signs their copy of the sale contract; the buyer signs their copy, and the two parties exchange their signed contracts. It is usual at this time for the buyer to pay a deposit, usually 10% of the purchase price.

Urgent Spousal Maintenance in Family Law Claims

In circumstances where one spouse requires immediate financial assistance from the other spouse, the Court may decide that these financial needs are so urgent and immediate and therefore may make orders for the capable spouse to pay these needs pending finalisation and consideration of the matter at large.

The Law

Section 77 of the Act states for spouses:

Urgent spousal maintenance cases

Where, in proceedings with respect to the maintenance of a party to a marriage, it appears to the Court that the party is in immediate need of financial assistance, but it is not practicable in the circumstances to determine immediately what order, if any, should be made, the Court may order the payment, pending the disposal of the proceedings, of such periodic sum or other sums as the Court considers reasonable.

Can you lawfully use physical force to correct your children?

As a parent, you might have a difficult situation mending the ways of your children without using physical force. Sometimes, you might feel the need to ‘reasonably chastise’ your children when they exhibit unacceptable behaviour. While traditionally the law has acknowledged that it is acceptable for a parent to use physical force on their children, the modern approach has denounced it.

In 2002, the government of New South Wales amended the Crimes Act 1900 (NSW) (‘the Act’) to include section 61AA. The introduction of this section brought clarity as to what is and what is not acceptable conduct to lawfully correct your children. The section sets out the circumstances in which the defence of ‘lawful correction’ may exist in a situation that might otherwise lead to a charge of assault against the parent.
