My father was my mentor. His name was James E. Wells. He taught me important principles in life, including that you needed to work hard to achieve your goals and to respect people, even if they are different than you. He was a practicing lawyer for years and became a judge in Municipal Court. Upon his retirement as Municipal Court judge he became a pro tem judge in District Court. My father passed away 8 years ago, but I still think of him and remember the things he taught me.

Doug Wells has been in private practice for 36 years. He is a frequent lecturer for continuing legal education classes around the state on topics such as: DUI defense, field sobriety tests and DUI law. His practice is currently focused on DUI Defense, primarily in NE Kansas. He has recently been notified of several awards and rankings that he has achieved for his work.
Wells has been selected by his peers for inclusion in the 2016 edition of The Best Lawyers in America in the practice area of DUI/DWI Defense. Only the top 4% of attorneys in the country are recognized in this publication. His law firm has also received a Tier 1 ranking, Topeka, for DUI/DWI defense by U.S. News & World Report and Best Lawyers in America.

[07/04/14]   Independence Day is day that commemorates the opportunities that we enjoy as Americans. We often take our freedom and liberty for granted. Our ancestors fought and some died to create a country based on freedom, where ordinary people have rights against a government that can be or might otherwise be oppressive. Even today our troops are fighting to help people obtain rights and to protect our freedom. Thank you to our troops. Remember that freedom dies when it is not exercised. You cannot exercise it if you do not think about it. Please take a moment today to appreciate the rights that we are blessed with.

The Topeka Police Department will conduct sobriety checkpoints during the Independence Day holiday.
The checkpoint will be held sometime between 11:30 p.m. Thursday and 2:30 a.m. Saturday.

[11/28/13]   Happy Thanksgiving!!

[11/01/13]   Doug is attending a conference with the the Kansas Association of Criminal Defense Lawyers in Wichita. He was a speaker at the conference this afternoon on the topic of Law Office Management. There are approximately 95 attorneys from throughout the state in attendance.

[10/31/13]   Recently the law changed to allow a person who has had their driver's license suspended for failure to pay traffic tickets to pay a $25.00 application fee to receive a restricted driver's license for 1 year so that they can get their tickets paid up. Formerly, a person was completely suspended from all driving until they could pay the tickets. After the payment of the application fee and approval of the application, the restrictions included going to, from, and in the course of employment; going to and returning from a healthcare appointment or a medical emergency; and going to or returning from probation meetings, drug and alcohol counseling, and any place required by the court.

[08/28/13]   Changes have been made by the legislature concerning the charge of boating under the influence. It is a crime to operate or attempt to operate a boat when you have a breath, blood or urine test of .08 or greater as measured within 3 hours of driving that boat or when you are under the influence of alcohol to a degree that renders a person incapable of safely operating the boat. Conviction of these charges can result in a jail sentence, a fine, suspension of your ability to operate a boat, and attendance in a boater safety education course. Conviction of these charges can be considered as a prior offense for driving under the influence.

Many people do not think about driving a boat after drinking a beer or alcohol. Be cautious because these penalties are becoming more severe.

[08/02/13]   From August 21 until August 24, I attended the National College for DUI Defense Summer Session in Cambridge, MA. The sessions were held in Austin Hall, the law school building at Harvard University.
At the Summer Session, I was designated as "college faculty". During this session, I participated as a break out co-leader in the area of cross-examination of an officer.
This is the 8th summer session I have attended. I have also attended numerous National College for DUI Defense (NCDD) winter meetings, mastering scientific evidence meetings, and Las Vegas meetings.
NCDD is an organization whose purpose is to assist and train attorneys in representing persons accused of driving under the influence of alcohol. During these meetings, I enjoy my relationships with excellent DUI attorneys throughout the country. We share strategies and techniques that assist us in representing our clients.

Independence Day is a meaningful day in honor of the freedoms and rights that we have in America. In my profession, I deal with the right to require the government to prove its case against my client beyond a doubt that is reasonable. This is so important! In our wonderful country, a person's freedom cannot be taken until or unless the government meets this burden. People are and should be presumed to be innocent. In many other countries, the government can punish a person whenever they chose to because they do not have these same rights. Please take a moment today to appreciate these rights so that we can all understand why they are so important.

Did you know that in Kansas refusing to take a blood, breath or urine test requested by an officer may be a criminal offense if it occurred after July 1, 2012 and if you have had a prior test refusal or DUI conviction after you were 18 years of age or older?
