Just in case you should find yourself in that awful situation of being arrested for a DUI - here's a video of Doug discussing what comes next in the legal process. My father was my mentor. His name was James E. Wells. He taught me important principles in life, including that you needed to work hard to achieve your goals and to respect people, even if they are different than you. He was a practicing lawyer for years and became a judge in Municipal Court. Upon his retirement as Municipal Court judge he became a pro tem judge in District Court. My father passed away 8 years ago, but I still think of him and remember the things he taught me.
Happy Father’s Day to all Dad’s! I hope you get to spend quality time relaxing with your family today!

Today is Flag Day! On May 30, 1916, President Woodrow Wilson issued a presidential proclamation establishing a national Flag Day on June 14, but it was not until 1949 that Congress voted for Flag Day to be a permanent holiday.
Americans celebrate Flag Day by displaying the Red, White and Blue in front of homes and businesses.
What do the colors of the US flag represent? From the American Legion website (www.legion.org) we learn: “According to custom and tradition, white signifies purity and innocence; red, hardiness and valor; and blue signifies vigilance, perseverance, and justice.”
Here is another website with more information regarding our flag: USFlag.org: A website dedicated to the Flag of the United States of ...

Happy Labor Day! Let's honor our working Americans today! Hope you have a safe happy Labor Day!

Have a happy & safe 4th of July celebration!

Happy Father's Day! Hope all you Dad's have a great day with your family doing something fun! I know I will!

This is a time to think of loved ones that have predeceased us as well as the brave who have made the ultimate sacrifice by giving their lives to protect us. For those whom we have known, this is a time to remember their contributions to our lives. For the solders that we may not have personally known, we should value their lives by protecting and enforcing the rights that they protected with their lives. It is easy to value freedom generally. I hope we can go beyond that to implement freedom in our lives by protecting our rights. I hope that we will not prejudge people, whether it is in court or in life.

Happy & safe holidays! I hope you enjoy a merry Christmas with family & friends. Please be responsible in selecting your driver!

Creativity abounds in Georgia.

[07/04/14]   Independence Day is day that commemorates the opportunities that we enjoy as Americans. We often take our freedom and liberty for granted. Our ancestors fought and some died to create a country based on freedom, where ordinary people have rights against a government that can be or might otherwise be oppressive. Even today our troops are fighting to help people obtain rights and to protect our freedom. Thank you to our troops. Remember that freedom dies when it is not exercised. You cannot exercise it if you do not think about it. Please take a moment today to appreciate the rights that we are blessed with.

[04/04/14]   The Topeka Police Department has announced that they will run a DUI Saturation Patrol April 5, this Saturday evening. As always, be safe!

[11/28/13]   Happy Thanksgiving!!

[11/01/13]   Doug is attending a conference with the the Kansas Association of Criminal Defense Lawyers in Wichita. He was a speaker at the conference this afternoon on the topic of Law Office Management. There are approximately 95 attorneys from throughout the state in attendance.

[10/31/13]   Recently the law changed to allow a person who has had their driver's license suspended for failure to pay traffic tickets to pay a $25.00 application fee to receive a restricted driver's license for 1 year so that they can get their tickets paid up. Formerly, a person was completely suspended from all driving until they could pay the tickets. After the payment of the application fee and approval of the application, the restrictions included going to, from, and in the course of employment; going to and returning from a healthcare appointment or a medical emergency; and going to or returning from probation meetings, drug and alcohol counseling, and any place required by the court.

[10/19/13]   Doug recently had a nice compliment paid to him by a client ; "I just wanted to take a minute to thank Mr. Wells for all his hard work and efforts in aiding me on my recent cases. I was more than pleased with the outcome. Thanks again and take care." Always nice to get the positive feedback.

[08/28/13]   Changes have been made by the legislature concerning the charge of boating under the influence. It is a crime to operate or attempt to operate a boat when you have a breath, blood or urine test of .08 or greater as measured within 3 hours of driving that boat or when you are under the influence of alcohol to a degree that renders a person incapable of safely operating the boat. Conviction of these charges can result in a jail sentence, a fine, suspension of your ability to operate a boat, and attendance in a boater safety education course. Conviction of these charges can be considered as a prior offense for driving under the influence.

Many people do not think about driving a boat after drinking a beer or alcohol. Be cautious because these penalties are becoming more severe.

[08/02/13]   From August 21 until August 24, I attended the National College for DUI Defense Summer Session in Cambridge, MA. The sessions were held in Austin Hall, the law school building at Harvard University.
At the Summer Session, I was designated as "college faculty". During this session, I participated as a break out co-leader in the area of cross-examination of an officer.
This is the 8th summer session I have attended. I have also attended numerous National College for DUI Defense (NCDD) winter meetings, mastering scientific evidence meetings, and Las Vegas meetings.
NCDD is an organization whose purpose is to assist and train attorneys in representing persons accused of driving under the influence of alcohol. During these meetings, I enjoy my relationships with excellent DUI attorneys throughout the country. We share strategies and techniques that assist us in representing our clients.

Independence Day is a meaningful day in honor of the freedoms and rights that we have in America. In my profession, I deal with the right to require the government to prove its case against my client beyond a doubt that is reasonable. This is so important! In our wonderful country, a person's freedom cannot be taken until or unless the government meets this burden. People are and should be presumed to be innocent. In many other countries, the government can punish a person whenever they chose to because they do not have these same rights. Please take a moment today to appreciate these rights so that we can all understand why they are so important.

[06/12/13]   If you are out & about this Saturday, June 15 in Topeka, please beware of possible sobriety check lanes between 10:30 Saturday night - 2:30 Sunday morning. Possible locations have been reported as:
■ S.W. 16th and Lane
■ S.W. 32nd and Lincoln
■ 200-300 block of S.W. Gage
■ 5000 block of S.W. Huntoon
■ 4500 block of S.W. Shunga Drive
■ S.E. 21st and Indiana

Please drive safely & responsibly!

[01/10/13]   Recent cliemt commentary on a card received by Doug: "I'm so grateful to you for what you have accomplished for our family. You're a dear man and I wish you every happiness and grace from above. Merry Christmas to you and yours."

[01/01/13]   Happy New Year's!! Please drive carefully & responsibly if you are out tonight!

[11/22/12]   Best wishes for a happy & safe Thanksgiving!

[10/18/12]   Doug has earned the Client Distinction Award from Martindale-Hubbell. He was rated by his clients in the areas of Communications Ability, Responsiveness, Quality of Service and Value for Money. He attained a rating score of over 4.5 (out of 5) to qualify for this award. The Client Distinction Award is given to less than 4% of the over 900,000 attorneys listed with Martindale-Hubbell. And, for the 12th year in a row, Wells has received a rating of “AV” in the Martindale Hubbell Law Directory. “AV” is the highest legal ability and ethical standards rating available.

Douglas Wells, Kansas DUI Attorney, Topeka and NE Kansas

Did you know that in Kansas refusing to take a blood, breath or urine test requested by an officer may be a criminal offense if it occurred after July 1, 2012 and if you have had a prior test refusal or DUI conviction after you were 18 years of age or older? If you have had no prior refusal or DUI convictions, refusing a breath test is not a crime but still may subject you to driver's license suspension and ignition interlock requirements. [07/23/12]   Recent e-mail from one of Doug's clients: "I am now back in Kansas and just wanted to first of all thank you for the work you did for my son. I am assuming from what he said that all is finished now. I must admit, I was somewhat surprised. Anyways, again, thank you for your help in this matter and (nothing personal) but I do hope I never have to employ your services again. Ha"
