What if I could guarantee a legal defense fund for every whistleblower? I established A4W as a "C" corporation with the intent that it would produce a profit that could serve the needs of whistleblowers. For the past several months, I have been silent while I worked to implement three of my ideas each of which is capable of producing 100's of millions of dollars annually. The first of these applications became sales ready today! As funds become available I will become a bigger and bigger problem for those in Congress that do not support immediate access to jury trials and for the removal of retaliators from federal service. Its time to break my silence. Since last July and the disclosures that were made regarding the membership of the Make-It-Safe Coalition (MISC) at the Whistleblowers Summit, I've contemplated what would be necessary to bring about significant changes in the protections for whistleblowers. Although the schedule of events for this year's Summit has not been posted, I encourage you to visit the site at https://www.whistleblowersummit.com and if at all possible plan to attend one session. Rest assured that the commotion I caused last year will pale to what I have planned for this year's events. If you attend, my tasking to you will be to bring a clipboard and a pen. I was told yesterday that the list is not up to date and that a new list will be published. However, one of the unions representing federal employees, the American Federation of Federal Employees (AFGE), remains as a member of the group that decides what is "best" for MISC. I was personally present in a meeting years ago when AFGE and the other unions walked out of a meeting called to support whistleblowers say, "It is too expensive to defend whistleblowers." That statement and the failure of AFGE locals to provide competent representation for whistleblowers is sufficient to question the legislative intentions of MISC and in particular how MISC's legislative priorities benefit MISC "leadership" as opposed to benefiting whistleblowers.
As some of you have learned, I have retired from the Coast Guard after tolerating too much hostility and acts of retaliation. For those of you on my email list you will soon receive an email asking for a pro bono legal opinion on aspects of S. 585. particularly as it may create a loophole for military whistleblowers and how it allows for the filing of a complaint with the Secretary of a Department asking for the removal of virtually any supervisor of any person who commits an act of retaliation against a WB. Because I believe in my Army Days motto of "Follow Me", I will be pressing for the removal of the Commandant of the Coast Guard and the rest of my chain of command. It's DayTime once again.
While we may not like the recent SCOTUS decision denying WBs protections who do not report violations to the Securities and Exchange Commission, I do believe it was consistent with the law. I think it is a good thing to have a court that will decide matters based on the law and not use the bench to legislate. As for the WB advocates, this is a good example of why there needs to be more cooperation and coordination of our legislative priorities.
Happy New Year to you all. Continuing with my comments regarding S. 585, it is my position that any, and every, federal employee may use S. 585 to make a request directly to the Head of "your" Agency (usually a Cabinet Secretary) asking for adverse discipline to include removal from federal service for any supervisor at any and every level of your chain of command who has acted or failed to act to cause or prevent an act of retaliation in the form of a Prohibited Personnel Practice (PPP) since the enactment of S. 585 on 10/26/2017. Furthermore, it is my position that this may be done separately or concurrently with the filing with the Office of Special Counsel or with the Merit Systems Protection Board. My next post will address how I will be applying this to my request for the removal of the Command of the Coast Guard.
Once you've read the text of S. 585, who are the supervisors who may be subjected to the 3-day suspension or more adverse discipline if it is determined by the Head of the Agency? Does the bill limit the discipline to the "immediate" supervisor or may it be applied to "any" supervisor? Can it be applied to the "supervisor" of an attorney who acts or fails to act to prevent retaliation? Is it limited to how high up in the chain of command to whom it may be applied? As I've been saying, the times are a changing and the time to end retaliation is at hand, or we will just get rid of some very rotten apples and dismiss them from federal service.
My answer to my post about the possible loophole in S. 585 fro uniformed whistleblowers, is first to remind readers that I am not a lawyer and that I will present the question to legal experts for their opinions. Meanwhile, if you are a uniformed federal employee, and in particular for those in the Coast Guard, I suggest to consider filing your request with the Secretary of Homeland Security.
As you have no doubt noted, I have been silent for quite some time, but my silence is over. Months ago, I was waiting for the enactment of S. 585 which was signed into law on October 26, 2017. I will be agressively implementing the provisions of the new law within the next few days. Now, I've also said that we, as whistleblowers, have to change the way we do business as the system of failed OSC investigations by and the extreme bias of MSPB have not served whistleblowers. If you have not read S. 585 it is imperative that you read it and that you bring it to the attention of every civilian and uniformed federal employee. So that you can appreciate my silence, I will be asking you several questions. The first question is, "If you are a uniformed "employee" in any department, can you appeal directly to the Head of the Agency (except an element of the intelligence community) for the "Secretary" to impose an adverse action on "any" supervisor who has engaged in acts of retaliation, or who has failed to prevent acts of retaliation? In other words, does S. 585 extend an element of whistleblower protections to uniformed members of the Army, Navy, Airforce, Marines, Coast Guard, and others?

I want to emphasize that while I believe that whistleblowers are critically important to the everyday operation of every business endeavor and government operations, the current system of protetions for federal employees provides far more protection to the perpetrators and to the retaliators (the criminals) then it provides real protection to any WB. What we need is a far better system of transparent disclosures and rapid investigations of every WB complaint. We need direct access to jury trials with meaningful and enforced penalties (preferably mandatory termination from federal service for the first offense) on the perpetrators and retaliators. I know that many readers of this column want to see the perpetrators and retaliators thrown in jail, I don't!!!! We need the adverse personnel actions as a deterent to the retaliation, but it someone is stupid enough to participate directly or indirectly in allowing retaliation, then I want them out of government service and that applies to the members of the uniformed services and to National Security personnel. If you are a new WB contemplating filing a complaint other than a qui tam case, please don't do it. The system is so stacked against you that no matter how credible your case (95% of all cases are credible allegations of waste, or abuse), historically only 7% of all cases filed with OSC are resolved favorably for the WB. I am patiently waiting for the confirmation of the new Special Cousel for OSC and I will generously give him 30-days to produce a new-day for OSC.
As some of you know I have been quietly contemplating a new strategy for whistleblowers and within the next few days I will release it. For starters, begin thinking about those who have commited acts of retaliation directily, or indirectly as "criminials". We will be applying that label to every level of management that fails to take an active role in ending retaliation. Add to that list those who would pat you on the back and thank you for all you've done, while doing nothing to end retaliation. I would suggest that we consider them as "criminal conspirators". Keep in mind that our objective is recognize that whistleblowing is crucial to the success of every organization be it corporate, military, or government. My effort to elevate every whistleblower to hero status is not just a slogan to be hyiacked for elected officials to pat themselves on the back for everytihg they've -- NOT DONE. At the same time, genuine heroes don't sit on their individual success or failure. I know that some, perhaps many of you, will do absolutely nothing to advance the greater good. On the ohter hand, there are a growing number of participants in this effort to make the cause of the whistleblower something much bigger that great. One of The Greatest Generation, my Father's Generation. The kind of man I grew up surrounded by in my segregated southern neighborhood. Before Black neighborhoods became infested with drugs and guns, when Families went to church once or twice a week. They worked Blue-collar and menial jobs, participated in and watched professional as well as neighborhood sports. They loved America and the Flag. Stopped whatever they were doing and stood at attention during the National Anthem. Yes, them stood in the back of the bus, and drank from water fountains designated as "For Colored Only". They responded politely when addressed as Boy, hey you, the N-word, and worse. But, they prayed for a brighter day further on up the road, and truly believed that thing were getting better every day. WHAT They DID NOT DO was loot, steal, burn buildings and others peoples' property. If they had deviant sexual predilections, they kept them in the closet. There was "A Sense of Privacy" then. They considered themselves as Americans; yes, Americans first and Black, second; not African or African-Americans. Many had been in America for up to 10 Generations, not Fresh-Off-The-Boat unassimilated Immigrants. They did not have high opinions of all of their fellow citizens from across the tracks, but they loved America. They were men with balls. They were not Snowflakes, wussies or wimps. Living in America is not always “peaches and cream”, if you are a Person of Color (POC). Life is not a Rose Garden for Black People no matter how well off you are economically. America can appear to be a Police State for a POC. Just going about your normal daily activities anywhere in America, chances are you are going to come into contact with police and other law enforcement personnel.
I have had many encounters with white cops. Most of them have been pleasant, some not so pleasant. It did not matter what I was wearing or the time of day, it was the character and education of the cop that determined how the situation was resolved. Sometimes I was wearing my military officers' uniform, other times I was wearing a suit and tie, but the manner that I was treated usually was determined by how comfortable the cop felt in dealing with a POC. I have been disrespected. I have been insulted. I have received Traffic Tickets. I have never been hand-cupped. I have never been arrested. I have never been beaten like Rodney King in California.

While it was initially an event co-produced with several independent whistleblowers and not-for-profit organizations, it has become an event largely controlled by one person who has excluded input from whistleblowers. [04/13/20]   While I have not posted for quite sometime, I remain very interested in issues impacting whistleblowers. 1) I have seen a letter being circulated by one of the leading non-profits that has represented itself as an advocate for WBs stating that jury trials is the top legislative priority for protecting WBs. This is BS. Let me reiterate that while jury trials in a federal court is far better than hearings at MSPB or EOC, it just means more money out of the pocket of WBs. Ending retaliation must be the legislative priority of every WB advocate and this will only come with removal of the retaliators and the perpetrators from federal service and barring any retaliatory commercial entity from receiving federal funds. Make your voices heard on this issue. 2) About a year ago I focused my attention on three projects that had the potential to produce significant income. The first project was related to updating a specific brand and model of computers and would have driven an immediate cash flow. I determined that the technical advice was faulty and abandoned this project. I moved directly to my second project and in the last year, I have traveled 44 of the 48 contiguous states to get information from as many as 500,000 venues. My trips to the West Coast to get info from the 4 western states has been postponed because of the virus. Nevertheless, I am moving forward to address the technical issues of bring a major, database driven, web site online and conceivably be ready to start subscription sales in a matter of weeks. 3) There is one unresolved legal issue that is hindering me from doing more with the Alliance for Whistleblowers, Inc. However, there may be a silver lining that is keeping the organization alive and may offer another solution to ending retaliation. Once the virus backs down, I hope to meet with interested parties to discuss options. 4) If you are reading this, you should be aware that if I shutdown A4W I will delete this page. She was the most gracious lady under pressure while in the public spot light since Coretta Scott King, Myrlie Evers, and Jackie Kennedy all rolled into one. They mourned the death of their husbands. Belinda mourned the sacrifice of her son, and the death of his Coast Guard career.
The civilian employees at the Coast Guard Academy could not help but notice, her poise and dignity under such enormous pressure. They were mothers and sisters. Webster could have been their son or brother. They were so moved that they were compelled to act. They had to reach out to her in a practical way. They presented her with a note and a gift. The card read,
"We are so proud of the way you have carried yourself here, with much dignity and poise. Please take this small token of respect and do something nice for yourself. “

Belinda Smith found some relief in writing a journal. She reduced her thoughts to writing. This is a sample:
