[03/26/19]   Welcome back to the Top Ten Reasons you DON'T Need to Hire an Estate Planning Attorney...

Number 4: You have more money than you know what to do with and so you actually WANT to pay taxes on your estate.

Does this sound as ridiculous as it is supposed to? I hope so! Sadly, there are too many instances where this has actually happened - the most obvious of which are Prince and Aretha Franklin. They both passed away with enormous holdings and yet had no estate plan, leaving the government to help themselves. Lately in the political environment I have even heard people tout their desire to simply allow the Feds to take their estate taxes.

Today, the estate and gift tax deduction is extremely high - at $11.2M per person ($22.4M per couple). But these caps "sunset" in 2025, at which time the deduction could go back down to $5.6M per person). Political winds are constantly changing, and even these levels could change in the future.

[03/13/19]   Top Ten Reasons you DON'T Need to Hire an Estate Planning Attorney...

Number 5: My family can sort it all out after I'm gone.

Maybe you think your family can work together to handle your affairs when you are gone. I even remember my grandfather saying this once (but at least he had a will!) But there are a number of problems with this belief. First, if you become incapacitated or mentally incompetent, your family member(s) will have to go to court to be appointed as guardian/conservator to be able to act on your behalf. A simple medical and financial power of attorney prepared now is much easier and far less expensive. Second, as discussed in our Top Ten's number 6, most families will suffer internal arguments and disputes over how things should be handled, and what you would have wanted. Taking even a small amount of time to prepare a will and give your family direction is invaluable. Finally, it is far less expensive and less time consuming to prepare your estate plan now rather than paying lawyers to go through the probate process. So if you love your family, show them how much you love them by managing your affairs now!

Number 6: Everyone in your family gets along perfectly, so they can just divide everything up when you're gone.

This one is my personal favorite. I hear it frequently, and I actually even believed it once, too. Before it happened to us, I never could have imagined a family being torn apart at the seams, when siblings that otherwise got along were just diving up responsibilities and inheriting equal shares of an estate.

Your family might be the exception rather than the rule. I sure hope that is the case. But the only way to truly make sure that your family is protected is to have your affairs in order!

[03/05/19]   Continuing the Top TEN Reasons why you DON'T Need to Hire an Estate Planning Attorney...

Number 7: "I prepared my estate documents back in 2005..."

This is certainly better than not having anything prepared. And your plan might still be in perfect order! But I recommend that my clients consider redoing their estate planning documents about every 10-15 years. There is no hard and fast rule. However, laws are constantly changing, and to ensure that you have the most up to date planning, you should at least have your documents reviewed by a qualified attorney to make sure they are current.

I also recommend that you review your existing estate documents any time there is a significant event in your life - a birth, death, change in friendships, relocation, marriage, divorce, and so on - to identify any changes that you would like to make.

Number 8: "I already prepared my estate documents (will, trust, etc.) in another state."

Many of my clients have prepared their estate documents in another state before moving to Colorado. While Colorado honors documents from other states, there are differences in the legal requirements from state to state. Some states follow the "uniform" probate code and/or the "uniform" trust code, which is designed to bring uniformity to the various states' laws. But many of the states still have their own state-specific laws that apply to wills and trusts.

The Ala Firm conducts a complimentary review of our client's out-of-state documents to ensure that the documents are compliant with Colorado law. In some cases, we recommend that amendments be prepared to change the location of a trust, and/or change the governing laws cited in the documents from the original state to Colorado.

Number 9: You don't have any money or assets to give to anyone.

There's a lot more to estate planning than what happens to your money. We also help you create powers of attorney so that someone you trust can make medical decisions for you and handle your financial affairs if you are incapacitated. And most importantly, if you have children, you should choose who will care for them if something should happen to you.
