R: El término "ciudad santuario" puede ser confuso. En general, el término se aplica a una ciudad, condado, o estado que promulga políticas policiales comunitarias que limitan la participación de la policía local en la aplicación federal de inmigración. Por ejemplo, la policía en un condado santuario puede negarse a detener a un individuo en la cárcel debido únicamente a su estado migratorio.

Los organismos encargados de hacer cumplir la ley en estas comunidades "del santuario" creen que tales limitaciones benefician a la seguridad pública, porque permiten a los residentes reportar crímenes y cooperar con las investigaciones sin temor por su estatus legal. También aseguran que la policía no detenga ilegalmente a las personas.

Las comunidades del santuario NO previenen la aplicación federal de la inmigración. Desde 2012, cuando alguna persona no ciudadano es llevado bajo custodia por el estado o un cuerpo de seguridad local, sus huellas son compartidas con el Servicio de Inmigración y Control de Aduanas (ICE, por sus siglas en inglés), que es una división del Departamento de Seguridad Nacional. Esto significa que ICE tiene información sobre cualquier persona no ciudadano que ingresa al sistema de justicia penal, y puede decidir si debe seguir la aplicación de la ley de inmigración, sin la cooperación de la policía local.

Answer: The term “sanctuary city” can be confusing. In general, the term applies to a city, county, or state that enacts community policing policies that limit local law enforcement’s involvement with federal immigration enforcement. For example, police in a sanctuary county may refuse to hold an individual in jail due solely to his or her immigration status.

Law enforcement agencies in these “sanctuary” communities believe such limitations benefit public safety, because they allow residents to report crimes and cooperate with investigations without fear over their legal status. They also ensure that police do not unlawfully detain people.

Sanctuary communities do NOT prevent federal immigration enforcement. Since 2012, when a non-citizen is taken into custody by state or local law enforcement, his or her fingerprints are shared with Immigration and Customs Enforcement (ICE), which is a division of the Department of Homeland Security. This means that ICE has information about any non-citizen who enters the criminal justice system, and can decide whether to pursue immigration enforcement, regardless of whether local law enforcement is involved.
