linkedin.com Today, April 2, 2020, we are in the midst of the corona virus emergency. The advice I'm about to give is relevant to these frantic times, but it will still be relevant years from now.

[03/31/20]   UPDATE: WE'RE STILL ON THE JOB

At our partners meeting yesterday, we all resolved to remain on the case and on the job. We will be closing our physical office for the time being for the safety of our staff and clients. However, we are still operating at capacity and will continue to serve our clients via telephone, email and video conferencing. We will be using the "Zoom" app, so if you need to have a virtual meeting, please download that app and contact us to arrange a meeting.

[03/20/20]   A MESSAGE TO OUR CLIENTS:
Magner Law has not closed down. In fact, with all of the other closings and postponements and delays, we've been working harder than ever this week for our clients - getting cases rescheduled and working with the courts and other attorneys. We are also helping our small business clients modify their contracts and draft change orders to accommodate this situation as it develops to avoid disputes and litigation in the future. We are here and we are on the job and we are going to stay on the job.

[03/18/20]   STUCK AT HOME?
Now is a GREAT time to get around to that estate planning that you've been putting off. Magner Law can conduct the initial consult via telephone, collect your information via email, and prepare your estate documents all without you ever leaving your house. Once this crisis has passed, we can schedule a document signing that will take only a few minutes. Give us a call at 540-431-4400.

[03/12/20]   A MESSAGE TO OUR CLIENTS:
We at ML realize that mass hysteria over the corona virus is taking hold of people, governments and institutions. However, ML has elected not to participate in that hysteria. Our clients have paid us good money and have entrusted us to do a job, and we're going to do that job.

Yes, we are being extra cautious and will be wiping down surfaces in our office with antibacterial wipes. Yes, we will conduct as much of our business electronically as we can. Yes, we will gladly accommodate our clients who opt for telephone conferences over face to face meetings. We want our clients and our staff to be safe and healthy. But we are not willing to sacrifice the quality of service that we pride ourselves on.

Your legal affairs will not be neglected. If you have questions, please do not hesitate to contact us.

For Sale by Fiduciary

https://www.linkedin.com/pulse/sale-fiduciary-james-magner

linkedin.com One common scenario that clients and real estate agents bring to me involves the sale of a home or other property that is held in the name of a trust, or that is being handled by a fiduciary such as a guardian, conservator or agent under a power of attorney. The questions are typically: "Whose name

[10/17/19]   A while back, I wrote an article about the complexities of dealing with a deceased loved one's social media and other online accounts. In the article, I predicted that the law would eventually catch up. It has. In Virginia, we have now adopted the "Uniform Fiduciary Access to Digital Assets Act" which provides estate fiduciaries, including Trustees and Executors, with access to the decedent's online accounts. This fixes a HUGE problem in the law, but, it also allows you to designate a specific person to have control over your accounts if anything happens to you.

If you are interested in this issue and what to know how to protect your digital privacy and dignity, give us a call.

How Much Fell Through the Cracks?

linkedin.com Whenever a client calls to tell me that someone has passed away and that the client has been left in charge, the very first thing I tell them to do is hang up, call a locksmith and call me back when the decedent’s home has been secured. The NEXT conversation typically involves me asking questions ...

[06/12/19]   I will be giving a presentation tomorrow afternoon (4:00 pm) at Poet's Walk in Leesburg on the topic of "What to do if My Parents Never did Any Estate Planning." I'll be discussing the legal options for the family as well as giving some advice about things to do to prepare BEFORE they become incapacitated. I am told that light refreshments will be served.

A Troubling Message

linkedin.com I've noticed a troubling trend in TV crime dramas. The "good guy" cops throw wild accusations around and arrest people on the flimsiest hunch, and then interrogate them in ways that stamp all over their rights, and then, when the "innocent" character says that he didn't do it ("Honest! Really! I wou

linkedin.com Everyone is familiar with the old proverb, "When all you have is a hammer, everything looks like a nail." The same is true of lawyers.

A win for people who park too long: Tire marking thrown out | WTOP

This is a nice decision because it enforces the rule of law and constitutional rights as absolutes; the government can't skirt the constitution even for minor issues like parking tickets. Rights are rights. Period.

https://wtop.com/national/2019/04/a-win-for-people-who-park-too-long-tire-chalking-thrown-out/

wtop.com Marking tires to enforce parking rules is like entering property without a search warrant, a federal court said Monday as it declared the practice unconstitutional in Michigan and three other states.

[04/19/19]   The toughest question I get asked as a lawyer is, "What do you think I should I do?" This is especially tough with estate planning clients, who are looking for suggestions on how to handle certain situations. For example, lets say the client wants to leave his house to his two adult children, but worries that one of them will want to keep the house and the other will want to sell it. The client isn't sure how to resolve that conundrum and is looking for suggestions. I'll go over the client's options with him and explain the various pros and cons of each, but ultimately, the client has to make the decision. When the client asks, "What do you think is the best way to handle that?" it is tempting to recommend a course of action, just as I would for a criminal defense client or a litigation client, but in the estate case, this is supposed to be the CLIENT'S last will, not mine.

There are two methods of getting a divorce: 1) you can agree that the relationship has ended and try to work through the problem of untangling your lives and assets through compromise and agreement; or, 2) you can have a knock-down drag-out in the courts and litigate the entire process. Guess which one is better for us and which one is better for our clients?

Divorce with dignity. It's not only possible, it's preferable.

The Law is not a "Technicality"

linkedin.com We've all heard the tired trope on TV and in the movies: the cops arrested some scoundrel, but he hires a slick (read: "evil") defense attorney, and gets off on a "technicality." Except the "technicality" they are referring to is usually the Constitution or criminal procedure.

The schedule has been released. Magner Law will be traveling to Richmond on January 10, 2019 to appear before the Virginia Supreme Court. We will be arguing our appeal in the case of Mercer v. MacKinnon, and the issue is whether a non-US Citizen who gets appointed as a conservator for an incapacitated person in a Virginia Court, but then returns to their own country with the money can be hauled back into a Virginia Court to answer for her use of the funds. I have personally been working on this case for close to four years, and if we win, we will be headed back to the Loudoun Circuit Court for trial. Wish us, and our client, luck!

Have you ever considered what happens to all of those accounts after you pass away? No? Neither has anyone else, frankly.

[09/05/18]   Magner Law isn't expanding... we've expanded, and we need to bring in talent to help carry the load. We're looking to talk to any solo practice attorneys who passed the bar in the last couple of years who might be interested in merging their practice with us. If you or anyone you know fits that description, drop us a line!
