The Sebastian County Bar Association is spotlighting each contested judicial election in our area. Early voting started February 18 and election day is March 3.

For Fort Smith District Judge, Position 3, the two candidates are Michael Gean Pierce and Judge Claire Borengasser. Michael Gean Pierce is currently an attorney at Gean, Gean & Gean Law Firm. His Q&A follows:

Q: Why are you running for judge?
A: I am running for District Court Judge because I believe that I can make a difference in my community by making much needed improvements with the court. Fort Smith needs a boost of energy and a continued progression of the court with new ideas and a fresh perspective.

Q: What makes you the most qualified candidate to be elected to the position you are seeking?
A: I am the most qualified candidate at this position because I have both private and public service experience. I have been in front of numerous courts and judges at various levels for both civil and criminal cases. This experience gives me the ability to put the good and bad policies I've experienced in our area to work for our community.

Q: What are the most important attributes for a judge to possess, and how do you display these attributes?
A: A judge needs to possess the ability to connect with all people in our community. I have experienced Fort Smith on both the North and South sides of our community. I enjoy both areas of our town and have the ability to relate to all people in Fort Smith.

Q: What changes do you intend to implement should you be elected?
A: The 1st change I intend to implement is to end the practice of standardized offers in Fort Smith District Court. Each case should be given an individualized approach based on the circumstances of that particular case. We can no longer accept cookie cutter justice in our city.

Q: What is the most meaningful case in which you have participated?
A: The most meaningful cases I have participated in have been those affecting the well being of children in our community. I have been involved in these cases both as a deputy prosecuting attorney in Sebastian County and as a private attorney. Keeping our children safe and secure in Fort Smith is always a truly rewarding endeavor.

Q: Who has had the greatest influence on you in your legal career?
A: My family has been the greatest influence on my legal career. My family has been serving the Fort Smith Communities legal needs at Gean, Gean & Gean Attorney's at Law for over the past 100 years in downtown Fort Smith. These attorneys include of Roy Gean Sr., Roy Gean Jr., Paul Gean, Roy Gean III, Ellen Gean, Tom Gean, David Gean and Elizabeth Gean Roberts.

Even though the undisputed facts are (1. in 2015-16, my opponent, Borengasser, sold all of her real property in Fort Smith 2. in 2017 she purchased a home, in Fayetteville, that she has valued at over ½ million dollars and 3. she has only rented a duplex in Fort Smith since this time), I voluntarily dropped the law suit I filed challenging my opponents’ residency. The suit was voluntarily non-suited by my own choice over 3 months ago on November 1, 2019 stating that I felt at this time it was best for the voters of Sebastian County to determine who their next Sebastian County District Judge should be instead of attempting to remove her from the ballot. My goal was for the people of Fort Smith to be aware of my opponents lack of commitment to our community while she has been presiding as one of our judges in Fort Smith.
I am making this post in response to an article from the Southwest Times Record relating to the law suit. The article alluded there were no issues with my opponents residency because of the dismissal. Unfortunately, Max Bryan, of the Southwest Times Records, never had any contact with me whatsoever regarding the article, its accuracy or my comment.
The photos of the Borengasser home in Fayetteville and a copy of the Motion for Voluntary Non-Suit are attached to this post.
I leave it to the voters to use their own discretion on what commitment level I have to Fort Smith and the commitment level of my opponent based on her own actions! Fort Smith will not play 2nd Fiddle to Fayetteville!
